SAPS-SITA EXPOSED

R1.3m a month paid to Mr and Mrs SAPS director and deputy director's child
A consultant employed by
the South African Police Service (SAPS), whose highest qualification was matric, was paid R1.3 million a month.
This was revealed by Sindi Chikunga, chairwoman of the National Assembly police oversight committee, during a hearing with the SAPS and the State Information Technology Agency (Sita) yesterday.

The consultant’s mother had been working as a director and her father as a deputy director at the SAPS, Chikunga said. Police national commissioner General Bheki Cele had on a previous occasion confirmed this.

Cele did not answer repeated calls made to him about the matter.

But, appearing before the committee a few months ago, he mentioned that the Special Investigating Unit (SIU) was investigating a married couple who had been employed by the SAPS, the wife being a director and the husband a deputy-director.

The couple owned a company that received tenders for services provided to the SAPS. The couple’s daughter, who was apparently still in school, did work for the SAPS through the company on behalf of the family.

Police spokesman Vish Naidoo said he could not confirm that the consultant mentioned in yesterday’s meeting and the daughter referred to by Cele was the same person.

Chikunga said the case was alarming and indicated the serious problems the SAPS faced. “If a matriculant earns R1.3m per month… there are serious problems.

“What special services are you going to get from a matriculant that you cannot get from someone in the SAPS? It’s concerning and shows the issues that are there and what’s going on in the department,” said Chikunga.
MPs accused the SAPS of handing over blank cheques to Sita without properly planning the use of the money. “They get allocated the money and then they say, ‘Oh, what do we need to do with it’,” said ANC MP Greg Schneemann.

Police commander Laytoa Tshabalala, the head of SAPS’s technology unit, agreed with Schneemann’s sentiment. He said he had addressed with the SAPS and Sita the “tell us how much you earn and we’ll help you spend it” tendencies.

MPs questioned the business relationship between the SAPS and Sita, which provides technological services.

ANC MP Annelise van Wyk said: “This is absolutely ridiculous. SAPS is Sita’s biggest client. There are serious concerns in the way SAPS determines priorities. I wonder whether this relationship is unhealthy.”

Tshabalala said the SAPS had had serious doubts about renewing its contract with Sita this year.

“The management of SAPS resisted giving the money to Sita. We were seriously toying with the idea to not go into business with them.”

Tshabalala, who only recently started working for the unit, said that on his arrival he was shocked at the state of the business practices.

“I was saying, it can’t be that Sita is the only (service provider). There were people who were working for Sita that came from SAPS. How is it that we allowed this mafia to run amok for so long?”

He said almost half of the consultants used by Sita were employed by the SAPS.

“It’s no point cleaning on one side and not the other. You must clean both sides,” he added.

Cop jailed for making cases disappear

Johannesburg - The Wolmaransstad Regional Court has sentenced a police constable to three years in jail for corruption, North West police said on Sunday.
"He was found guilty of soliciting money from stock thieves in order to withdraw their cases," spokesperson Brigadier Thulane Ngubane said.
The court found on Friday that Constable GJ Molamu, 34, had on several occasions met two suspects facing charges of stock theft. Molamu, based at the stock theft unit in Wolmaransstad, had promised to withdraw their cases in exchange for money.
"He had already been paid R3000 before he was arrested in 2011."
A trap was set for him and he was arrested when one of the alleged stock thieves handed him R2000 at a filling station in Wolmaransstad.

Vehicle hijackings in Gauteng have decreased from 25 to 16 a day. Provincial police commissioner Mzwandile Petros says it is a significant reduction and police do not plan to change their crime-fighting strategy.

Police fooled by jailbird brigadier

WHEN Joburg police circulated a picture of an alleged killer who had escaped from custody, alarm bells rang for their counterparts in KwaZulu-Natal, where some knew him for his sterling work as a policeman.
Now it has emerged that the man, Zimbabwean Musa Khumalo, is not only wanted for murder – but also for impersonating a policeman for almost a year.
He reportedly escaped from prison and fled to KZN, where he got himself a senior position in the police and used his power to take down hijacking syndicates. Khumalo escaped from a Joburg jail early last year, apparently with the help of a warder. He’d been held on a charge of murder.
It appears that after his escape he headed for Durban, adopted the rank of brigadier, and worked for months at various northern KZN police stations. During that time he was lauded for his success rate, having recovered more than 40 stolen and hijacked cars.
But it seems that his achievements may not have been due to good police work, but rather his determination to take down rival hijackers.
“There is reason to believe that Khumalo was allegedly involved in a car theft and hijacking syndicate. He was suffocating his rivals in crime to help sustain his alleged operation,” said a well-placed source.
Hawks spokesman McIntosh Polela said a warrant of arrest had been issued for Khumalo, and national police commissioner General Riah Phiyega and Hawks boss Lieutenant General Anwa Dramat were determined to see him behind bars. Crime intelligence units and tracking teams in KZN and Gauteng have been instructed to work around the clock to catch Khumalo, who may have fled back to Joburg.
Polela said the details of the Joburg murder for which he was originally arrested were unclear, but he could confirm that Khumalo had escaped from custody.
He said Khumalo claimed he was a policeman based at the KZN provincial headquarters. But KZN police spokesman Colonel Vincent Mdunge claimed Khumalo was an impostor.
“Since his picture was circulated as a wanted criminal, we have secured his profile. A task team has been appointed to track him down. He does not use an alias. This is his name. We will find him,” he said.
“The picture in his passport and that on the wanted persons list are a match. He is aware that police are looking for him.”
Mdunge denied claims that the KZN police commissioner, Lieutenant General Mmamonnye Ngobeni, knew Khumalo.
The police source described Khumalo as a “hardcore criminal” with alleged links to a car theft and hijacking syndicate in KZN, adding that Khumalo had an SA ID and passport. “He entered the country legally from Zimbabwe. It is unknown how he obtained these falsified documents. According to the Department of Home Affairs, Khumalo was declared dead in 2008.”
The source said that when Khumalo escaped from police custody in Joburg, he fled to KZN.
“When he got here, he befriended several policemen. He gave them the impression that he was a policeman, too. He introduced himself as Brigadier Musa Khumalo and claimed to be from the Hawks in Pretoria. He soon gained the trust of the policemen and started assisting them with investigations.”
The source said Khumalo was knowledgeable about SA policing and investigation methods.
“He knew what he was talking about. So much so that professional policemen believed him.
“He seemed to have good informers when it came to car theft and hijacking syndicates operating in KZN,” the source said, explaining how Khumalo helped the police to recover 26 stolen and hijacked cars in Richards Bay and 19 in Mtunzini. “The engine numbers of these stolen cars were checked and they showed on the system as stolen or hijacked. This just gained him more trust and recognition.”

Cop held for theft back at work

A POLICE sergeant arrested two months ago after he allegedly stole jewellery worth more than R200000 from a woman who had tried to commit suicide is back at work at the Kabega Park police station.
Sergeant Reece Dhanda, 36, who is facing a charge of theft, reported for duty yesterday. His service pistol, which was confiscated in September when he was arrested, was handed back to him.
Police spokesman Lieutenant-Colonel Sibongile Soci said yesterday afternoon she was still waiting for a response from the relevant department regarding Dhanda’s reinstatement.

Irate police officers at Kabega Park, who did not want to be named, were furious that he was back at work.
“We noticed this morning that he is back on duty serving the community he is alleged to have stolen from. We have a feeling someone did not do his job properly. This guy needs to be suspended,” one officer said.
The state alleges that on August 17, two police constables and Dhanda were dispatched to a house in Sherwood following a frantic call from Lifeline to attend to a woman in her 50s who had taken an overdose of tablets.
When they arrived at the house, a jewellery box containing two rings – valued at R128000 and at R110000 – sat on top of a dressing table.

The rings were normally kept locked away and had only been taken out because the woman and her husband wanted to send them to their daughter in Gauteng. The theft was only discovered after the woman was discharged from hospital.
All three officers initially denied their involvement. They were then booked to undergo polygraph tests, but before the process could take place one of them decided to talk. He alleged he had seen Dhanda putting the items in his pocket. The two constables passed the polygraph test but Dhanda allegedly refused to take it.
He was arrested on September 19 and is out on R1000 bail. Two days later, the rings were mysteriously found in the woman’s postbox.

Another police officer, who also did not want to be named, said it was unfair that Dhanda had not been suspended. “This morning, he was working together with the people supposed to be witnesses in the case. He can easily influence the witnesses. Something needs to be done quickly.”
Dhanda is due to appear in court on January 27.

Solidarity takes SAPS to court over affirmative action policy

Trade union Solidarity filed papers at the Johannesburg Labour Court, asking for the SA Police Service (SAPS) affirmative action plan to be declared invalid.

Solidarity deputy general secretary Dirk Hermann said in a statement that the union aimed to dismantle the entire plan.
"We cannot continue taking individual cases to court. Now for the first time we are taking to court the root of the problem, namely absolute racial representation," he said.
The union had already taken the SAPS to court in 14 separate cases.
Police Minister Nathi Mthethwa, Labour Minister Mildred Oliphant and police commissioner General Riah Phiyega were named as respondents in the documents.
Mthethwa's spokesman Zweli Mnisi said he had not seen the papers, and could not comment on its contents.
"[It is] safe to say if the matter is brought before court, then our legal team will handle the matter accordingly."
In the papers Solidarity claimed that the SAPS's affirmative action plan amounted to social manipulation based on blatant race and gender quotas.
It said the 'ideal' race-based targets set by the SAPS affirmative action plan between 2010 to 2014 were 79.35 percent for Africans, 2.46 percent for Indians, 8.85 percent for coloureds and 9.34 percent for whites.
The union claimed this was unconstitutional.
"Under the Constitution it is impermissible to discriminate on the grounds of race and gender. The Employment Equity Act, in outlawing discrimination, echoes this principle," the papers said.
It said the "naked pursuit" of demographic representation based on racial factors can never be lawful.
"The enactments legitimate affirmative action measures in order to redress the inequities of the past, but they positively decline to sanction social engineering mechanically designed to produce racial and gender representation in the future."
It said that the plan did not take into account the regional differences in racial demographics.
"For example, the representation of coloured people is made to depend on national demographics despite the preponderance of such persons in the Western Cape."
Hermann said the "problem" with absolute racial representation was that employers were beginning to "believe it was proper thing to do".
"Solidarity wants to petition the court to give its verdict on the question of whether this practice is allowed by the Employment Equity Act and the Constitution of South Africa," he said.
"The irony is that this racial ideology is hitting ordinary South Africans the hardest: people who are victims of poor service in various areas, including poor policing service."
He said the court date for the case had not been set yet.

Police not meeting target practice obligations

Nearly 60 percent of Gauteng police officers did not meet their annual target practice obligations in 2011, according to a report on Monday (18/06/2012).

Beeld newspaper reported that target practice attendance figures had dropped by nearly 40 percent over a three-year period.

According to the answer to a parliamentary question by the Democratic Alliance, 21,477 police officers attended target practice courses during 2009, compared to just 13,332 in 2011.

The number of hours that Gauteng police spent on the shooting range, dropped during the same period from 171,576 to 106,656.

According to DA spokesman for social development Mike Waters, at least 18,761 officers (58.5 percent of the 32,093 in Gauteng) did not report for target practice at all in 2011.

This was regardless of the fact that Lt-Gen Nhlanhla Mkhwanazi, the then acting chief of police, explicitly stated that target practice once a year was an integral requirement for the issuing of firearm licences to police officers.

According to police spokesman Colonel Noxolo Kweza, the Gauteng police decided that in 2012, it would focus on firearm competence, and that target practice would not be seen as a priority.

Waters said it was crucially important for police officials to attend target practice sessions to ensure that their competence remained at a high level. - Sapa
