Van der Vyver wins civil claim, but would the police ever pay?

Former murder-accused, Fred van der Vyver got the green light from the courts to bring a R46 million claim against the police for malicious prosecution, but he might just be wasting his time. With the police’s track record of damages payment, there’s every chance that he will never see the money. CARIEN DU PLESSIS reports.
It was an emotional end to six years of court battles after Fred van der Vyver, now an actuarial assistant, was accused of murdering his girlfriend and fellow Stellenbosch student at the time, Inge Lotz.

Four years ago, he was acquitted of the murder, and on Monday, Cape High Court Judge Anton Veldhuizen found that there was no evidence to indicate that Van der Vyver had killed her. Veldhuizen ruled that Van der Vyver could continue with his civil claim against the police.

Another process will now have to start next year to determine how much of the R46 million he’s claiming he is entitled to.

But he might have to wait a while, as police ministry spokesman Zweli Mnisi said the police’s lawyers were studying the judgement and are likely to appeal – something which has become something of a reflex reaction for the police in civil cases, and the SA government as a whole.

Even if Van der Vyver holds out for another couple of years, pushes through, fights the appeal and gets an award (which would include his legal costs), the police has a very bad track record of actually paying up.
DA police spokeswoman Dianne Kohler-Barnard said the police’s legal services “have been dysfunctional for years”.

She had been waging a campaign against the former head of legal services, Lindiwe Mtimkulu, who was suspended last year after an R8 million investigation found gross mismanagement of the police litigation services under her watch.
Kohler-Barnard said the problems remained and the police was more likely to fight court cases than actually conceding when they were wrong and pay up.
“Your chances of being paid out by the police are very low,” she said.
Kohler-Barnard said the best way to go about claims against the police is to approach the Independent Complaints Directorate to sue the police on your behalf.
While this is not the usual procedure in a case like Van der Vyver’s, it is technically possible.

The police investigation itself was also a “shambles”, forensics expert David Klatzow told Daily Maverick.

He said police laboratories have been in steady decline, making it almost impossible for police to back up cases with evidence.
Klatzow said there were many cases like Van der Vyver’s coming before the courts now, because of this decline.

“The labs are on the edge of collapse, and now you are starting to see the effect of this in open court.”
Van der Vyver’s was a high profile case, but Klatzow said he was dealing with another case where the accused had been in prison for 12 years while the police was trying to prove a case on fractured evidence.
Klatzow said the problem was also that incompetent people were appointed in the police and labs. “Political interference in the appointment of police staff is a problem.”

He reckons Van der Vyver’s case against the police was good. “Police are planning to appeal an unappealable case. They should just bow out and pay the price for it”. DM

RELIVING THE TRAUMA: The mother of the three-year-old girl who was allegedly raped in Leaches Bay on Saturday. In the picture, she is speaking with her neighbour who accompanied her daughter to Fleet Street Police Station Picture: SINO MAJANGAZA
RESIDENTS of Leaches Bay have lambasted the manner in which police handled the alleged rape of a three-year-old girl at the weekend and said officers were trying to cover up their incompetence.

Eyewitnesses who approached the Daily Dispatch yesterday to give their version of events of Saturday night – where an alleged rapist was stoned to death by community members – rejected claims by police the suspect had fled by the time officers arrived on the scene.

They accused police of not carrying out their duties properly by:
• Not arresting the suspect;
• Only taking the three-year-old rape victim to hospital hours after the attack; and
• Inflaming tensions in the community by the manner in which they conducted their subsequent investigations.

An eyewitness who asked to remain anonymous said that after police were called to the scene, two officers arrived driving a white car .
“They did not even ask about the whereabouts of the suspect,” she said. “He was in his shack and now (police are) saying he was not found.
“I personally asked them why they were leaving the suspect behind and they did not respond.”

She said they thought the officers were going to call for a police van to collect the suspect.

“But it is obvious that they did not do that,” she said.
“But still they did not come. What did they expect? They are the ones who should be charged for murder,” said the woman.
Another community member who also witnessed the incident said the police had been incompetent.

“We would not be in this mess if those incompetent police officers did their job properly,” she said, adding that the statement made by police that the suspect had fled was completely inaccurate.

“There was no manhunt that was launched by the community to look for him; he was always in his shack.”
The mother of the young girl who was raped claimed she was receiving threats from relatives of three men arrested in connection with the mob justice attack on the suspected rapist.

She alleged that police had picked up her 14-year-old son for questioning and despite the fact he had given a statement denying seeing who had carried out the attack, police had arrested three men.
“I feel victimised,” she said. “My three-year-old daughter was raped, my 14-year-old is accused of pointing out the killers of the rapist and now I am receiving threats .

“They questioned my son in my absence and later they arrested people.
“Now the community has the impression that it is my son who told the police that the arrested people are the ones responsible for the killing of the suspect.”
Meanwhile, the neighbour of the three-year-old rape victim said she had accompanied the young girl, and the girl’s older sister, with police officers to Fleet Street Police Station.

She alleges they were made to wait at the station for more than two hours unattended.
“We stayed there not receiving any help"

South Africans march against crime : London interviews

South Africans congregated in London yesterday, in an attempt to create awareness regarding the crime in SA, and the state things are in at the moment. The march started just a little after 11:00 at Piccadilly Circus in central London. It was an hour-long static march that ended at the South African Embassy’s doorstep.

Everyone was wearing read t-shirts which symbolised the innocent blood that has and is being spilt in South Africa. Besides the two ANC reporters at the march, there were no other ethnic South African groups that participated in the march. Click here to view the full story with photographs.

The Independent Complaints Directorate (ICD) on Tuesday said it would be investigating a case of police brutality against an officer at the Vaalwater Police Station in Limpopo.

The case revolves around cellphone video footage that has come to the attention of the Mail & Guardian.

Warning: This video contains footage of a violent nature

The footage shows a uniformed police officer assaulting an unarmed man while in the process of arresting him -- the officer's police van is also clearly identified.

The suspect is punched, kicked in the head, dragged and strangled as community members look on.

The ICD's spokesperson Moses Dlamini said they would contact the police station after being sent the footage by the M&G.

When contacted, officers at the Vaalwater Police Station confirmed that a case had been opened but would not divulge the officer's identity, claiming the case was "sub judice".

The video was first posted on the 2OceansVibe website on March 9 2012. The suspect's identity is unknown.

Nine people, including six members of the South African Police Service, were arrested on fraud charges involving more than R2,5million.
They were arrested by the Mpumalanga organised crime unit on Friday after a year-long investigation into their alleged fraudulent activities.
Two of those arrested were husband and wife, Jacobus Petrus Basson, 38, and Captain Lana Basson, 38.

Captain Basson is attached to the police's stolen vehicles exhibit centre in Nelspruit, while her husband is a former policeman.
Lana was arrested in full view of her colleagues, some of whom peered through windows as she was led away by members of the organised crime police unit.
She was handcuffed and her face covered with a cloth before police headed for her home to arrest her husband.

But her husband was not at home and the police instructed his wife to call him and tell him to come home urgently, which he did minutes later.
"We have a warrant of arrest that we are happy to execute against you right away. You are now under arrest on charges of fraud and you have the right to remain silent if you so wish," police organised crime unit head Superintendent Obed Ngwenya told Jacobus before handcuffing him.

The police later arrested seven others who are also alleged to have been involved in the irregular procurement of contracts.

All the suspects appeared in the Nelspruit magistrate's court, where they were released on warning pending their next court appearance on June 21.

The other accused are: former Inspector Izaak Bester, 39, logistics clerical assistant Zelda Badenhorst, 44, Nelspruit police station accounting officer Lynette Maria Roussouw, 51, KaBokweni police financial clerk Charles Thomas Erasmus, 37, Inspector Vicky van Wyk, 34, Lydenburg police supply chain management clerk Riaan Kruger, 35, and another unidentified suspect.

"The investigations into the allegations that led to the arrest of the suspects started in April last year," Captain Leonard Hlathi said yesterday.
"This was a syndicate that has cost the police service more than R2,5million and we believe we have made a breakthrough."

Police Crime Intelligence Unit raids public protector offices
Alex Eliseev | 03 Mar 2011

A Police Crime Intelligence Unit has raided the offices of the public protector just days after it released a damning report into a R500 million property deal involving National Commissioner General Bheki Cele. The raid took place on Wednesday.

Eyewitness News understands officers were searching for documents relating to the report.

Cele’s office has condemned the raid saying it did not authorise it and will take urgent steps against those involved.

“We strongly condemn the raid on the Public Protector’s office, it was not sanctioned by

management of the Saps (South African Police Service). Appropriate steps will be taken against those who conducted the raid and against the person, or people, who sanctioned the raid,” said the police’s McIntosh Polela.

Just days ago, Public Protector Thuli Madonsela released her report into the controversial R500 million deal. She found that the deal, which included Cele, the Department of Public Works and businessman Roux Shabangu, was "fatally flawed".

While she found that no crime had taken place, she called for the national Treasury to investigate further and for action to be taken against those involved.

Cele had asked for certain information from the public protector but was not given access. It remains to be seen if those documents are amongst those seized in the raid.

The public protector’s office said it would release a response to the raid soon.

Meanwhile, Cabinet said during its briefing on Thursday that it was not aware of the raid.
Government spokesperson Jimmy Manyi also reiterated that he would not answer questions about Presidency Minister Trevor Manuel’s scathing letter to him.
In the letter, which was published on Wednesday, Manuel accused Manyi of being guilty of apartheid thinking for saying there was an over-concentration of Coloureds in the Western Cape.

He also called him a racist and a tribalist.
The Congress of South African Trade Unions said the comments draw Manyi’s suitability for the post into question.
Manyi has remained defiant.

“I can tell you right now, Cabinet did not discuss that matter. So I will not be responding to questions on that. Yesterday I responded saying I have no comment on the matter and I will continue to have no comment on the matter,” he said.

Okah's wife accuses police of murder

The wife of terror accused Henry Okah on Sunday accused the living in her Turffontein house. Azuka Okah said she owns the semi-detached house but rented it to what she calls a "quiet, respectable man from Nigeria".

She said witnesses told her masked police broke into the house on Saturday and assaulted people inside. The Nigerian man allegedly died after his hands and feet were tied and his head was dunked in water.

Okah said officers did not take statements from witnesses.
The Independent Complaints Directorate (ICD) is investigating if police were responsible for the man's death."We would be interviewing more witness if they do come up and we are investigation a case of possible death as a result of police action," said the ICD's Tiyani Sambo.

Cocaine, ammunition and a pistol were found in the house during the police raid and residents confirmed the area is known to be a hub of drug activity. It is believed police had been tipped off about the Nigerian's alleged involvement in drug dealing.

Police sergeant held for murder

A police sergeant has been arrested for the death of a Boksburg man in police custody, the Independent Complaints Directorate (ICD) said on Tuesday.
21 February 2012 | Sapa

JOHANNESBURG - A police sergeant has been arrested for the death of a Boksburg man in police custody, the Independent Complaints Directorate (ICD) said on Tuesday.

"This arrest follows an investigation by the ICD which was started soon after the incident was reported," spokesman Moses Dlamini said in a statement.

The Beeld reported on Monday that Rean Ramdin, 29, died after he was shot by a policeman after being arrested during a raid at Presley's nightclub in Boksburg.

According to the report he was handcuffed when he was shot. The family had searched for Ramdin after he failed to return home. They identified his body at the Springs mortuary.

Dlamini said police claimed they were called to the club after the Ramdin was allegedly found with drugs.

"They took Mr Ramdin away in a police vehicle after handcuffing him. It is alleged that he jumped out of the vehicle and ran away," said Dlamini.

"The police shot and killed him after he allegedly ignored warning shots."

The 39-year-old officer was expected to appear in the Boksburg Magistrate's Court on Wednesday.

Police crime intelligence chief appears in court with two other officials on murder charges. ERNEST MABUZA
Published: 2011/04/01 06:33:18 AM

POLICE crime intelligence chief Lt-Gen Richard Mdluli appeared in court yesterday afternoon with two other officials on murder charges.
He appeared with warrant officer Samuel Dlomo and a colonel from crime intelligence, Nkosana Ximba, on charges relating to a man who opened a case of attempted murder before his death in 1999.

The three were not asked to plead and were remanded until their next court appearance, next Thursday in the Boksburg Magistrate’s Court.
They face three counts of intimidation, three counts of kidnapping, two counts of assault with intent to commit grievous bodily harm, murder, attempted murder, conspiracy to commit murder, and defeating the course of justice.
The charges relate to the period when Lt-Gen Mdluli was station commander at the Vosloorus police station in Ekurhuleni. National Prosecuting Authority spokesman Mthunzi Mhaga said Lt-Gen Mdluli, accompanied by his lawyer, handed himself over to the court .

Immediately after he was appointed head of crime intelligence in 1999, Lt-Gen Mdluli’s integrity was questioned when reports surfaced that he could have been involved in the murder of Oupa Ramogibe. The Ramogibe family in Vosloorus said Mr Ramogibe was murdered after being threatened by Lt-Gen Mdluli.
Police also confirmed that Lt-Gen Mdluli’s arrest had nothing to do with the case of Czech fraud accused Radovan Krejcir.
