Robbed by EMPD
He added that when pulled over, he remained compliant and civil to the three officers.
December 31, 2014

Mr Smith was told the Edenvale SAPS could not open a case against EMPD officers.
Aggressive officers from the Ekurhuleni Metropolitan Police Department (EMPD) threatened Edenvale resident, Mr Brian Smith*, with arrest before taking money and a GPS from his car.
When he tried to lay a charge against the officers, Mr Smith was told the Edenvale SAPS could not open a case against EMPD officers.
Mr Smith was returning home from a function at the Birchwood Conference Centre on Friday night, November 14, when he was stopped by EMPD officers at the intersection of First Avenue and Horwood Street.
“The officers were waiting at the intersection and I had seen their blue lights flashing from some distance away. I had only consumed three Savannah Dry drinks over the course of the evening and was not concerned about my alcohol levels, or about my fitness to drive,” said Mr Smith.
He added that when pulled over, he remained compliant and civil to the three officers.
“The officers were in uniform and had official EMPD vehicles in attendance,” he said.
The officers claimed he was drunk and threatened Mr Smith with arrest, without conducting a breathalyser test or offering to take him for blood tests.
“I was asked to get out of my car and two of the officers plundered the vehicle, while their colleague verbally threatened and abused me to keep me out of their way,” Mr Smith said.
He added that the officers wore no name tags and refused to produce appointment certificates when he asked.
“They were arrogant and I was outnumbered and intimidated. When I took out my cellular phone to call my attorney, the interrogating officer knocked it out of my hand onto the street, breaking the screen in the process,” said Mr Smith.
“My GPS, as well as its mounting and power cord, were removed from its bag in my cubby hole and about R1 400 was taken from a bag in my boot. The officers also removed R120 from my back pocket,” he said.
Mr Smith later found that his girlfriend’s purse, which contained a small amount of cash and credit cards, had also been taken from his boot.
“I was then sworn at and told to leave. I was in shock and received trauma counselling the following day,” he said.
“When I visited the Edenvale Police Station on November 16 to lay a charge against the officers involved, I was told the Edenvale SAPS could not lay a change against officers from the EMPD and that the matter would be investigated internally by the EMPD,” said Mr Smith.
“The worst case scenario in this matter is that those officers were legitimate metro officers who are meant to protect us as citizens,” said Mr Smith.
The acting spokesperson for the Edenvale SAPS, Lieutenant Colonel Robbie Roberts, said Mr Smith should not have been refused help when he wanted to open a case against the officers involved.
“We cannot accept this type of behaviour. A full investigation will be launched to get to the bottom of this matter,” said Lt Col Roberts.
The spokesperson for the EMPD, Chief Superintendent Wilfred Kgasago, said contact would be made with Mr Smith and a case opened against the officers involved.
The matter will be investigated by the Standards and Integrity Unit of the EMPD.

Russell Smith

A CITY man has lodged a complaint of police misconduct against the Knysna police station after he says he was held in cells overnight without cause.

Russell Smith, 39, was in Knysna for the Pink Loerie Mardi Gras and Arts Festival last weekend when he says he was arrested and kept overnight in a cell without explanation.

Smith is the operations director for Adventure Bookings in Cape Town.

Saps spokesperson Malcolm Pojie said the station had received the complaint, but could not comment further.

“The complainant will be liaised with directly and be kept up to date regarding this investigation,” Pojie said.

Pojie would not respond to any questions related to Smith’s allegations.

In his letter to Knysna Station Commander Colonel Atwell Metu, Smith said the incident, “makes a mockery of the police force”, and that he “…was not being drunk and disorderly”.

He explained in his letter that he was on his way home from a club early on Saturday when he was accosted by a homeless man on Main Road. Worried that the confrontation might escalate, Smith began to run to his hotel on the next street.

Smith says that’s when a police van with two officers pulled up. One officer got out and stuck his hands in Smith’s pockets.

“I got really uncomfortable with the way his hands were in my pockets and I said, ‘I’ll empty my own pockets’,” Smith told the Cape Times.

Smith’s complaint says the officers then told him they were charging him with being “drunk in public” and bundled him into the car.

“I didn’t want to argue because I did have a couple of drinks,” Smith said.

“I didn’t want to get into a fight.”

Smith said when they got to the station, there were already 12 others who were being held. His complaint states that the officers were “physically beating up guys and making them sign a charge document”.

Smith said they didn’t take any identifying information like fingerprints or an ID number before taking his phone, wallet, and other items and putting him in a cell.

Smith was charged with “drunkenness”, even though he also says there was no breathalyser or blood alcohol test. Smith’s lawyer, Zwaai Kruger said “drunkenness” was not a real charge, and the law the officers cited was incorrect. When Kruger went to court on Monday morning, he found that Smith’s name had not been placed on the roll.

Cop accused in sex case: Sergeant charges station commander
By Asanda Nini - October 29, 2016

The Independent Police Investigative Directorate (Ipid) is investigating a sexual harassment case against a top Eastern Cape policeman.
The senior officer allegedly sexually assaulted a policewoman and made inappropriate sexual comments towards her.
The harassment case was opened last month at a Buffalo City Metro police station after the officer, who is a station commander, allegedly touched the breasts of a female sergeant at his station on September 18.
The Independent Police Investigative Directorate (Ipid) is investigating a sexual harassment case against a top Eastern Cape policeman
The station commander, who cannot be named until he pleads in a court of law as it involves a sexual offence, yesterday refused to comment on the allegations and referred questions to the police’s provincial communications unit.
Provincial police spokesman Khaya Thonjeni yesterday confirmed that a sexual harassment case had been opened against the officer at the police station of which he is commander and that the docket was later transferred to Ipid “for further handling and investigation”.
“The South African Police Services takes allegations of this nature very seriously and will comply with the Ipid recommendations on the matter,” Thonjeni said.
He referred further queries to Ipid spokesman Moses Dlamini who confirmed that Ipid had completed its investigation and that recommendations had been prepared for the National Prosecuting Authority to decide.
The policewoman is said to be receiving counselling over her alleged ordeal, and has refused to go back to work for the past three weeks after her pleas to provincial police bosses for a transfer were not heeded.
The policewoman yesterday said she had been away from work because “I could not cope with the stress of working closely with my abuser”.
She refused to comment more “for fear of further victimisation”.
It is understood she immediately reported the matter to her immediate supervisor, and later to provincial police when asking for a transfer.
One colleague who asked to remain anonymous said she was “devastated, traumatised and so emotionally drained” as a result of the incident, and that “she will have to get further counselling in order for her to one day overcome the trauma that came with this gruesome act perpetrated by someone she trusted.
“She cries almost all the time and she is even scared to even come to work,” said her colleague. — asandan@dispatch.co.za

Sex workers sjambokked by police
Two sex workers stated that this had not been the first time that they were mistreated in a violent manner by policemen
January 15, 2015

According to a sex worker operating on Prince Alfred and Burger Streets last Monday, four of them were sjambokked, fined and detained by policemen.
Two sex workers that did not wished to be named stated that this had not been the first time that they were mistreated in a violent manner by policemen. One of the two workers mentioned that they had to resort to prostitution to earn some form of income to support their families, because of the lack of employment in the city.
Police spokesperson Captain Zenzele Ndlovu confirmed that the police have a duty to the state to reduce and eradicate criminal activities in the city and prostitution is certainly a contributing factor to the increase of criminal activity in the downtown area of Pietermaritzburg.
