2011-11-10 Picture: the driver of MEC Humphrey Mmemezi's luxury BMW X5 is well-known in Krugersdorp for his high-speed, rude behaviour in traffic, witnesses say … and when he got out of the car, he never even glanced at the critically-injured Afrikaner youth he’d run down: he merely went to inspect the damage to the car, witnesses say.

Louise Ferreira, Beeld journalist, is writing that ‘the driver who ran down Thomas Ferreira, 18, of Krugersdorp on his bike Saturday, has not been charged. SAPS lt.col Katlego Mogale says 'statements have not yet been taken from witnesses'. Mogale told Ferreira that 'a case of reckless and negligent driving is being investigated, but that ‘the man would not be arrested but a warning would be issued for him to appear in court ".

Thomas, still in a coma with suspected brain-damage, is meanwhile undergoing surgery on his badly damaged arm and a leg, said his uncle Johan Ferreira.
And while the officials of the Gauteng provincial government including premier Nomvula Mokonyane continue to confirm that MEC Mmemezi was inside the high-speed, blue-light official vehicle, he himself insists that he was not in the car. Ms Mokonyane had said in an extraordinary interview with the news media outside the Ferreira family home that the MEC 'was inside the car but was immediately whisked away from the accident scene by body-guards' and 'rushed to an urgent meeting in Krugersdorp.'

Krugersdorp residents Lizanne and Peet van Wyk and other witnesses said this was however not the case; that the driver 'definitely was alone inside the vehicle." Mrs van Wyk told Ferreira that: 'it's not possible that he could have been sitting on the back seat. He would have needed medical treatment. And what about his bodyguards? We would have seen them too". Other witnesses such as George Stander of Cape Town who was with a group of friends that night, said the same thing: "There were three people in shorts who climbed from a taxi. Don't tell me those were bodyguards. Those were the only people we saw around (the driver).'
Stander's friend Niel Muller of Krugersdorp agreed: It was Muller who took the photographs of the accident scene: Ferreira's bike, the government-BMW and also photographed the driver getting out of the BMW alone.

Another friend in this group also said he 'walked past the BMW to look at the damage. "There was no-one on the front seat. "On the left rear window the airbag had expanded and there was no-one on the rear seat, unless it was a very tiny person hiding in the car-boot, there was no-one'. The Premier’s spokesman Xoli Mngambi however still insisted when speaking to Ms Ferreira that the MEC had been inside the car. Asked by Beeld why Mmemezi and his driver had not gone over to the badly injured Thomas Ferreira, Mngambi said: "they did not want to interfere in the CRIME SCENE...' He also refused to say what could have been so urgent for the MEC's official to rush at high speed through a red-light at the intersection with their blue-lights flashing. "It forms part of the official police-investigation and we cannot divulge that information,' Mngambi said.

Meanwhile a worker at a Krugersdorp insleepdiens, Frik Niemand, said he often parks his van at the corner of Shannon- and Voortrekker Road where Ferreira was run over. A speed-camera is installed there, and the camera records that particular BMW X5 day and night. 'The man nearly run me off the road once,' he said. Yet people are too terrified to testify against this government-driver in court about his allegedly bullying, high-speed behaviour in traffic. "If people don't get out of his way, he blasts away on his car-horn, curses and shouts. He recognised the driver from pictures published in Beeld. "He often drives on Voortrekker Road and he NEVER drives slowly,' he emphasized.

“Shopowner George Santos borrowed police’s bullet-proof vest and caught the burglars himself”

On 1 June 2009, Mr George Santos’ shop was broken into north of De Wildt. A strange event then followed, and it was actually recorded on Santos’ own security cameras.
On this video, it can be clearly seen how nine burly police officers of Mmakau simply refused to enter the building. It’s also seen on this video that Santos then borrows one of the police officers’ bullet-proof vests and walks into his shop to confront the burglars himself.

• Nine police officers – too cowardly to do their jobs. These suspects were arrested only due to Santos’ own initiative but have since then already been released on bail.

Police tell the public to police themselves…
• Alas police strategies has all but divorced itself from the aforementioned and it is evident that demands are constantly being made upon the public to police themselves and use the SAPS as a reporting mechanism with the police adopting a predominantly reactive role.

Many communities are not very cooperative with the police in the first instance as they perceive the police as a joke when they view the physical attributes of some police men and women, their inability to exercise literacy skills and the polices general reluctance to respond to complaints.

It is interesting to note that Ask Afrika’s Orange Index gave the S A Police Service a zero percent rating whilst private security companies achieved a 60.71% rating. http://www.askafrika.co.za/metho_orange.htm

He was taken intact to a Kriel police cell without any apparent injuries. Yet despite repeated attempts by relatives to explain his medical condition to the police -- and to try and get him out of the police holding cell and released into their custody, this defenceless old man was found beaten to death the next morning with these fresh, hook-shaped head wounds and other bruises to his face.

Pretoria cop arrested in armed robbery

Pretoria-Central police station’s law court orderly arrested after an armed robbery in Erasmia…

Apr 14 2009 -- Fanie van Rooyen of Beeld newspaper reports that a police officer who works at the Pretoria-Central police station was arrested minutes after he was spotted running away with two other armed men after they had attacked a woman and her child at her home in Theron Street, demanding money.

The cop was arrested by two neighbours across the street after he and two armed men had just fled from trying to rob the family at 9am. Captain Tessa Jansen said the owner of the attacked home was attacked when she was inside with her child and a housekeeper.

Builders were working at the house - and thus when the men knocked on the door, the woman had opened the door and was immediately held at gunpoint.
• The men pushed the woman and her child into a bedroom, demanding money. However she grabbed her child, rushed off, locked herself into a bathroom and then started screaming loudly for help from the barred bathroom window.
The robbers then ran off - however a neighbour's 16-year-old son spotted one man running away after hearing the woman's cries for help, and chased after him, immediately joined by an adult family member.

The two males grabbed the escaping alleged robber and sat down on top of him, waiting for the armed-reaction unit which the victim had alerted with an emergency button.

The arrested man, who had two handguns with him when arrested, told armed-response security guards, who had been the first to respond to the emergency call, that 'he was being falsely accused by the community, that he was a cop.'
Captain Jansen said he was taken to Erasmia police station, where he was arrested after police questioned everyone concerned. Also arrested was the victim's housekeeper - after it was found by the police that she knew one of the three robbers.
• The other two are still at large, but police have meanwhile brought the policeman and the housekeeper up for charges, and they will appear in the Atteridge magistrate's court on Thursday, April 16.

Afrikaans journo Yolanda Barnard of Sondag: ‘The four cops told me they pulled me over because I was white,' she said… Afrikaans news-photographer Craig Nieuwenhuizen was bashed, kicked and beaten by security guards at the Unisa campus while investigating a story on Tuesday.



Jacques Steenkamp of Beeld newspaper writes that Afrikaans journalist Yolanda Barnard, 32, entertainment-reporter for Sondag tabloid, suffered a cracked nose-bone when she was battered in the face by a black policewoman on Sunday-afternoon Aug 22 2011. She has lodged charges at Midrand police station. Miss Barnard had just left the 'Liedjieboer-Kroeg', an Afrikaans entertainment venue at Olifantsfontein Road in Midrand, on Sunday at 4:15pm. She had spent the afternoon with entertainers Kurt Darren, DJ Ossewa and others to celebrate singer Pieter Smith's birthday.

"I had a few drinks but also had a lot to eat,' she said. "I drove myself because I was not drunk. About a block away from the venue I was pulled over by four black police members. I asked them why they pulled me over specifically, and they said 'because you are white,' she said. The four cops, three men and a woman, ordered her to follow them and the four cops climbed back into their minibus. She followed them in her car because she believed they would just go to the nearest police station. However instead they stopped in a quiet dead-end street, demanded her driver's license and her keys.

"I wanted to know again why they pulled me over and the woman said 'because you are drunk.' I asked them to do a breathaliser test right there and then -- because I know I was not drunk. The black female cop then battered me in the face. 'Ms Barnard was then grabbed by her arms and legs by the police woman and a male cop, and they carried her to the minibus. The other two black male cops stood there and laughed at her humiliation. "I then told them that I was a journalist, and they suddenly dropped me right there on the tarmac. I jumped up and locked myself into my car."

An hour later, after posting at her car all that time, the four cops apparently decided they'd had enough and they all got back into the minivan. Ms Barnard then climbed out and pleaded with them to give her back her driver's license and keys. They threw her belongings on the ground from the bus. She never was charged with anything. "I am now terrified of the police. How can anyone trust them after such an incident?" she said. She was examined by a doctor who confirmed her suspicion that a bone may have been cracked in her nose. Editor of Sondag newspaper Peet Bothma said the newspaper takes a very strong stand against police cruelty and assaults, just as any other newspaper should also do. "We support Yolanda completely in lodging her criminal charges, as well as the civil claim she will be lodging,' he said. SAPS captain Agnes Huma confirmed that the journalist lodged formal charges of assault and intimidation against the specific police members involved.

Mrs Naomi Harmse cursed as 'white bitch', beaten with fist by black Vanderbijlpark cop



2011-08-25 - A black police officer at Vanderbijlpark who attempted to take a cellphone from Mrs Naomi Harmse, cursed her for a 'white bitch,' assaulted her in the charge office, sat on top of her and pummeled her in the face with a fist. Mrs Naomi Harmse (28) was driving on Faraday Street in Vanderbijlpark on Friday-night with a male friend at 23:15 enroute home when rubbish on the road when she was forced off the road by a car - and this caused a burst tyre. Just as they were being forced off the road a car stopped behind them. "I thought it was the car which had forced us off the road and asked the male person why he had done this.' Then a number of other unknown black men exited the car behind them - and descended on the white couple's car. They plucked her friend from her car and started dragging him away while she tried to stop them from attacking him. But the local police then showed up and arrested the Afrikaans couple. At the charge office she was forbidden to make any calls, even though she was being arrested allegedly for assault - and had the legal right to call her lawyer to arrange for bail.

"I had hidden my cellphone so that I could call for help to get me out, but it rang and the cop at the charge office demanded that I give him my cellphone. I refused,' she said. "The next moment he was on top of me, threw me from the chair to the ground, sat on me, beat me with a fist in my face, called me a white bitch,' she said. Her friend dragged the black policeman off her. The couple remained in custody all weekend, and appeared in court on Monday on 'assault charges' and released on their own cognisance. She has lodged a formal charge against the police officer, confirmed warrant/officer Kinnie Steyn, who also confirmed the couple's arrest. It’s not known if a court-date was set for the ‘assault charge’.

Crime victims get penalised:

The question one must ask is the following: how can a society function effectively when productive people are penalised whenever they turn to the police to try and get crimes solved, while suspects are handled with kid-gloves?
If the police and the state’s sympathies lie with the criminals – as it increasingly appears to be – there’s certainly a screw lose. Because what is happening in De Wildt, is not unique, according to the many news reports.
Can South Africa really afford to lose the trust placed in our judicial system by economically-productive citizens?

Deaths in South African police custody rose to 912 in 2009

Cape Town – Deaths in police custody rose to 912 in 2009.. This is according to a press release on 26 September 2009 by the Independent Complaints Directorate. But the ICD says while these deaths had risen “from 791 the previous year’ , this fact “could not be read as a sign of an increase in police misconduct”. The directorate’s Francois Beukman says when considering the cases carried over from the previous year, the ICD had just more than 11,190 cases to deal with. According to the Mail and Guardian of Feb 13 2008, More than 800 KZN cops were under investigation for crimes ranging from assault through to rape and murder

Attacker was caught, then was allowed to escape from police custody:

It is believed that the attacker was caught, then escaped before he could be brought to the Pretoria North court on 31 October 2011 at 10am. Medical personnel have urged colleagues and friends to meet at the magistrate's court in Pretoria North on Monday from 09h45 to 010h15 to protest against the girl's torture-ordeal."Make a poster with impact, protest against this brutality,' said one of the medical staffers. Until the attacker is re-captured, this plan will have to be put on hold, however. Police have been slow to issue a description for the fugitive torturer.

28 October 2011 – An investigation into the conduct of an unidentified Daveyton EMPD police officer is being conducted by their own internal 'Integrity and Standards Unit’ after City Times journalist Michael Ferguson was illegally arrested while investigating charges of police-brutality against a local resident. After local community leaders intervened, Ferguson was released and the formal charges of (sic:) Ferguson of ‘interference to and officer performing his duty and taking him a photo’, were dropped.

City Times journalist Sandile van Heerden writes that 'the officer in question could face charges of intimidation and unlawful arrest, among others." The arrest occurred after the City Times received a call to report police brutality at the intersection of Bunyan Street and Lake Avenue in the Benoni CBD late on Thursday morning.
Hostile cop freaked out when Ferguson took photographs:

“When City Times journalist Michael Ferguson arrived at the scene he approached the officer in question, but was ignored until he began taking photographs.
"The officer was hostile and treated me as if I did not exist," he said. "When I started taking photographs he completely freaked out. He was shouting and screaming and he and his partner grabbed me, ripped my camera out of my hands, handcuffed me and threw me in the back of their van."

Ferguson was apprehended by the officer in question and his ‘partner’, who was however not a member of the Boksburg metropolitan-police force, but instead apparently is a member of the regular Daveyton SAPD instead.
Ferguson’s camera was confiscated, he was handcuffed and was placed in the back of a small van -- where he then was held for three and a half hours.
A member of the community alerted the newspaper again- this time to warn them that their journalist had been arrested.

Ferguson was trying to cover a ‘struggle between a staff member at a business and a police officer over a parking row’

It is reported that the officer and his partner had an argument with the owner of a nearby business regarding one of their trucks parked in the road. It was also reported that a struggle between a staff member of the business and the officer ensued, resulting in the staff member's shirt being ripped open.

The City Times, members of the community policing forum, SAPS and ward councillor Mary Goby all attended the scene to see what was happening. The officer in question, dressed in an EMPD T-shirt, refused to identify himself to the City Times and other community members. He also refused to take a call from the EMPD's head in Benoni, Supt Jacques Voster, saying; "He is not my boss."

Sandile van Heerden noted that the only comment the officer had on Ferguson’s arrest, was that he ‘was being detained for "interfering", but he would not elaborate. Van Heerden: “Ferguson was then taken to the Benoni Police Station by the officer, to have charges laid against him. CEO of the Benoni citizen-policing-forum Reza Patel then arrived on the scene and in turn contacted Boksburg metropolitian police chief-superintendent Hennie Erasmus of the Integrity and Standards Unit, to request his assistance in the matter. Erasmus arrived and took contact details from those on the scene, including the officer, and promised to conduct a thorough investigation into the matter.

The metro-cop’s partner later vanished and according to Van Heerden, ‘is said to be a member of the Daveyton SAPS. Erasmus reportedly said that ‘the accomplice will not be investigated by the EMPD, but will, instead, be reported to the SAPS.”

The charges against Ferguson: "Interference to, and [sic] officer performing his duty and taking him a photo," were later dropped.

‘Police-officers using police-vehicles to do their shopping’ :
-- Speaking on the number of officers seen using police vehicles to do shopping, Bill, also a resident, asked the station commander what was being done to monitor officers and how he can get members of the EMPD to be outside schools in the area to protect the children from speeding parents.

“We have the AVL which in your language is a tracker but we call it AVL. If you see a motor vehicle parked at the road side in the wrong place you can phone us,” Lt Col Mailula.

-- Bill also asked how he can get members of the EMPD to be outside schools in the area to protect the children from speeding parents when there is always a group of officers pulling people over for talking on their cellular telephones just a few blocks away. His second question was answered by Superintendent Gwen Gina from the metropolitan-police, the EMPD. “One of the duties of the EMPD is to enforce the National Road Traffic Act and this remains one of our major duties. We help the SAPS on operations too,” Supt Gina said.

-- Lindsay, a 21-year-old Edenvale resident, said that she would like to know how she can help as a 21-year-old in the community. “Yes we pay taxes but we are not involved in helping out,” Lindsay said. Mr Quintine Ndaba from the MEC for Community Safety’s Office said that in his view ‘one cannot just smile if they are a prisoner in their own homes: We cannot criticise without assistance. Your role as the EMPD is not only traffic laws but also visible policing and crime prevention,” he said in response to Supt Gina.

-- I feel safer living in Soweto… the area of Edenvale is under siege: One resident then stood up to correct Mr Ndaba, saying that every time she needed assistance, the metro police were there – but not the SAPS. “The SAPS is busy picking up and dropping off people. They are a taxi service while the EMPD was there to assist,” the resident said. Mr Ndaba replied: “We are all touched by the murders. In the words of the MEC, the area of Edenvale is under siege,” Mr Ndaba said while the residents applauded. “If you do not get help, come to my department,” he urged. “I live in Soweto and feel safer living in Soweto. Do you know why? Because we as a community joined hands and said enough is enough. “Know your neighbour. If something happens they must be able to assist,” he added.

Before the closing of the meeting, Lt Col Roberts addressed the community. “I do not live in Edenvale. I live in Kempton Park. I also do not know when I will receive the call that my house was broken into. So I have put security measures in place. “Everyone reads about the murders but did you read the crime tips published in the Bedfordview Edenvale NEWS? The crime tips are not simply sucked out of our thumbs they are based on crime trends in the area,” Lt Col Roberts said. He added the SAPS has regular operations to ensure the safety of the community.

Another resident asked what had happened to the Mercedes Benz A-Class which was donated to the Edenvale Police Station from Karaglen.
W/O Olckers said that “the vehicle was still in the service of the Edenvale SAPS but it had been removed from doing sector patrols in Edenvale”.

Edenvale resident, Mike, wanted to know how many vehicles there were in Edenvale and what sort of a budget the police have and what has been done in terms of getting more vehicles and manpower. “We have applied for more vehicles and more manpower. Edenvale is too big for six vehicles,” Lt Col Mailula said before being seated again. Her response to the question caused the audience to erupt into a flurry of questions.

-- Dowerglen extention 4 resident, Johnny, asked why the station has such a large turnaround of station commanders. “We were perfectly happy with the previous commander,” he said. In response to the question, Mr Andy Crawley said that he agreed that the matter needed to be taken up with Provincial Police Commissioner Lieutenant General Mzwandile Petros to create some sort of stability in Edenvale.
-- Heather Hart said that if Edenvale wanted a first class police station, the work should start at the front. “There is no sense of pride and respect. You are lucky to be greeted when entering the station. If you are not going to answer you phones then remove them,” she said. “We expect and deserve good service,” she added.

Why was an elderly woman arrested at a retirement village by heavily-armed police officers?

Following his address, the floor was opened to questions from the community.
One resident highlighted the arrest of an elderly woman, which saw a number of heavily armed police officers take her into custody at 1am in the morning at her home in a retirement village (See letter’s page). In response to this, W/O Olckers said that “the case was still under investigation and therefore he could not comment on the case but said that if it is found that there was any wrongdoing on the part of the police officers, that an investigation will be conducted”.
His comments spurred comments and questions from the audience.

The doctors are meanwhile telling the family that his recovery is satisfactory: there are signs that he may be able to breathe on his own, and a broken arm and leg were operated on. “The doctor is positive, but neurologically they cannot tell the extent of the damage. They are slowly bringing him out of his coma,’ said the father.

The official SAPS statements and the MEC’s spokesman up to that point had all claimed the opposite, namely that Mmemezi ‘was not inside the car and that the vehicle was not part of a blue-light convoy’. However Gauteng premier Nomvula Mokonyane and the MEC were inside the Ferreira home on Tuesday and then emerged to address the news media . Matric pupil Thomas Ferreira, 18, is in a coma with suspected brain damage after being knocked down - allegedly by the official blue-light BMW of a Gauteng MEC over the weekend. The Krugersdorp Afrikaans high school pupil on his way to his girlfriend’s home in Randfontein on his motorbike when he was hit by an official vehicle of Local Government and Housing MEC Humphrey Mmemezi. THE MEC WAS INSIDE THE VEHICLE AT THE TIME. The vehicle was a super-deluxe white BMW X5. Witnesses said the driver of the blue-light BMW 'did not even look at the child he'd knocked down: her got out to look at the damage to his car'. Thomas is in a critical condition in the ICU of the Krugersdorp Hospital. He has a fractured arm and leg, several facial fractures, and swelling and haemorrhaging of the brain. His parents, Paul and Priscilla Ferreira, said on Monday he is in a coma and on a ventilator.

"The hospital phoned this morning [Monday] to say they were going to perform an operation to insert a monitor in his brain and relieve the pressure," Ferreira said. "After the operation the doctor phoned to say it looks as if there is serious brain damage." "I then phoned his mother on my mother's phone and just heard, 'Annemarie, Thomas was in a very serious accident'." Afrikaans SAPS widow Margaretha Liza de Bruin sues SAPS for repeated false arrests 2011-11-02 source: Beeld journalist Hanti Otto - Margaretha (Liza) de Bruin, the widow of sergeant Daniël de Bruin, an SAPS national intervention unit officer who died in July last year with six other colleagues in a police chopper crash, is suing the authorities for R100,000 in damages after she was arrested twice on trumped-up charges and thrown into a police cell with male convicts.

Twice she was arrested and twice the charges against her were withdrawn. She was never charged with anything, said her legal counsel Carel Taute. He sent a notice of intention to sue to the authorities. Details submitted show that Mrs De Bruin, 28, Marthinus Nel, 22, and a 17-year-old youth were arrested as suspects in an armed robbery of a pub in March 2011 at Hermansstad, Pretoria. Mr Nel - the State alleged at the time -- was wearing her late husband's bulletproof vest, SAPS-appointment certificate and gun-holster. The three accused Afrikaners first appeared in the Atteridgeville regional court on 7 March - and at this point the state-prosecutor told the magistrate that 'the dossier was unclear as to exactly what they should be charged with'.

"The accused did not point the claimed weapon, apparently a gas-pistol, to anyone. Further investigations need to be undertaken to determine the exact charges.' Yet Mrs de Bruin and Mr Nel were held in custody for a week until they were released on R1,500 bail and the teenager was released in the care of his parents. On 28 April, they appeared in court again. Otto writes that this time, the charge sheet indicated that they are being charged with 'pointing an object with could have a person believe that it was a firearm; and for pretending to be police officers.

' There were statements submitted to the court that the man and the teenager had gone inside the pub while Mrs De Bruin remained outside in the car. The charges against them were withdrawn - but three months later they were charged again: only to have these charges withdrawn against them again on 25 October. Police resorted to rubber bullets and pepper spray to disperse the unruly crowd, and arrested 35 protestors for illegal gathering and public disturbance. Centre manager of Amajuba Mall, where some of the protestors were eventually arrested, Robbie Matthee, said the protest actually began at Majuba Lodge, where the ANC conference was being held, but protestors ran to the mall when police chased them. “We noticed that something was going on. The security guards at the mall acted quickly and managed to keep the protestors at one end of the mall, away from shoppers, until the police arrived,” said Mr Matthee. For weeks, certain ANC members have been calling for change within the regional executive of the party, complaining that the branch general meetings were being held in a manner that was factional and unconstitutional. Protests escalated when sit-ins were staged at the ANC offices. 73 members of the ANC who participated in the sit-in were arrested and charged with trespassing. It wasn’t long after, however, when a second sit-in was staged during which fire hydrants were opened, causing R30 000 worth of damage to a municipal building. Trespassing charges were withdrawn this week. This morning two bus loads of disgruntled ANC members gathered at Trim Park and made their way to Majuba Lodge to hand over a memorandum to KZN provincial chairperson of the ANC, Zweli Mkhize, who is currently conducting the election of the party’s regional executive. “We approached the protestors at Trim Park and told them that their march was unlawful but they forced their way to Majuba Lodge and they attacked us,” said SAPS communications officer, Warrant Officer Simon Luthuli, who formed part of the crew who tried to contain the protestors. During the regional conference which will continue tomorrow, Mr Mkhize said that the ANC was, “facing a crunch.” “There are internal challenges,” he said, addressing delegates at the conference. “We need to be open on how to deal with those challenges. Values of the ANC must not be eroded by the influx of new members or young members. November 28 2011 Sharon Gill writes: “The festive season is one of extremes. On the one hand we have general merriment, goodwill to all and an over-indulgence of food and alcohol. On the other hand we have criminals – both in and out of uniform – who have a different idea of what “Christmas giving” is all about.
According to eBlockWatch, reports of police intimidation and bribery are common, and festive season roadblocks are not always what they seem.

Fake roadblocks
There appears to be a network of police officers setting up fake roadblocks, using a complex scheme to get restaurant patrons to hand over their money.
According to eBlockwatch’s Andre Snyman, a group of sector police from Randburg, Sandton and metro police officers are allegedly using unmarked police cars to stake out expensive vehicles leaving expensive restaurants, and reporting the direction in which they are travelling to a second marked police car which follows the target car and pulls the driver over to warn them of a roadblock ahead.

Snyman said that numerous reports have indicated that the officers then try to intimidate the drivers, whether they’ve had a drink or not, threatening them that the roadblock personnel will arrest them for driving under the influence.
The drivers are told that they can drive off using an alternative route that will take them away from the roadblock if they pay a bribe.
However, the upcoming roadblock is also manned by the scammers, using another police van with blue lights flashing lights a bit further down the road.

Your rights

If a single police vehicle tries to pull you over, you have the right to slow down and continue driving at the legal speed limit to your nearest police station if you don’t feel comfortable pulling over on the side of the road. However, there’s a chance that if it’s a genuine police officer, he may misinterpret this as an attempt to evade arrest.
If a roadblock has been set up on a main road with multiple police vehicles and personnel, you are obligated to pull over. Police officers must be willing to identify themselves, as well as show physical identification. If they are not wearing full uniform or don’t have an identity badge displaying their name, you are within your rights to ask for another officer to attend to you.While it may be unnecessary, you are legally obliged to take a breathalyser test or be taken to the surgeon general.

Legal alcohol limit in SA: 0.24mg/litre
The legal alcohol limit in South Africa is 0.24mg/litre, or roughly one beer or shot of harder liquor every three to four hours for the average person.
Remember that number. 0.24mg/litre. The officer must show you the breathalyser reading. If you’re tested and register under the limit on a breathalyser, you cannot be arrested for drinking and driving. Any attempts by an officer to extort a bribe from you should be reported to your nearest police station, and there are ways in which you can gather evidence for your case.
• Snyman advises that you make a note of the licence plate number of the police vehicle and its service number, which is painted on the side of the vehicle next to the precinct name. Don’t have a pencil and paper? Save the numbers on your cell phone somewhere. Also, make a mental note of the number of officers, their race, names and any other identifying features that can be reported if a bribe is solicited.

The panic button calls for help and can pinpoint your location. Designed to provide drivers with the ability to record a conversation or bribery attempt, eBlockWatch’s system also sends out a message that you may be in trouble to four people designated by you, and reports the incident to your local police station.

So you’ve managed to take down the details of the officers and their vehicle and recorded the conversation, and still you are threatened with arrest or thrown into the back of a police car. What do you do now?
• The Justice Project South Africa also offers a service – Priority Assist – that provides 24-hour roadside assistance, 365 days a year, to anybody pulled over by the police and who feels threatened.

If you are threatened or arrested unlawfully, you or a family member can call the JPSA call centre, which can send legal help or provide assistance at any time of the day. People under the age of 30 years, women travelling on their own and senior citizens are usually the most likely to be targeted by corrupt police, but Priority Assist does not discriminate.“The service is not designed to interfere in any way with legitimate law enforcement, but is designed to actively and effectively deal with issues of corruption and abuse and give motorists the peace of mind in knowing that they are no longer alone when they become the target of a traffic stop,” the JPSA website reads.

• To access this service, one needs to sign up with the JPSA on their website which costs R50 a month per main member with an additional R25 for Priority Assist.

Panic button

eBlockWatch is actually an all-round emergency response team. You can set up a panic button on your cell phone that links you to four pre-selected people.
If you set up the Track Your Mate function, which enables phone tracking, hitting the panic button sends two SMS messages to your pre-selected four people: the first says you need help, the second gives your location. I tested it, writes Gill
“My son, who was more than 1,500 km away from me at the time, hit the panic button on his phone. Within a few seconds the first SMS came in saying he needed help, it gave his cell phone number to call to find out if he was in trouble, and gave the eBlockWatch emergency number to call if he did need help. The second SMS arrived while I was reading the first, and it gave his location down to the street and suburb he was in, as well as the nearest intersecting street.

That’s as far as the automated system goes unless you take further action. Since ours was a test, we left it at that. However, in the event that the person really is in trouble, one of the designated four would call the given emergency number, which would have eBlockWatch mobilising the troops.
It would also trigger the system to update the person’s location at regular intervals.

A spin-off to the panic button is the ability to install the Phone Home application on laptops and PCs, which can be used to track and recover these items if stolen.

566 people died in SAPS custody in 2010 alone…

There have been a great many deaths and severe injuries sustained by citizens at the hands of the SA police last year - at least 566 people are known to have died in 2010 alone in SAPS custody, for instance….

The frail 69-year-old Mrs Laynes had to be rushed to a public hospital to reset a broken hip while her elderly, beaten up husband and son were held overnight in Die Moot ‘s police cells. The two men were released on $50 bail without formal charges. Mr Strydom and Mr Laynes lodged formal assault complaints against the SAPS.

Mr Strydom told Beeld newspaper that a marked SAPS vehicle had suddenly pushed right in front of his dad’s car at a crossing because they were apprently chasing some unknown counter-traffic driver. The SAPS vehicle then screeched to a sudden halt right in front of the Laynes car. Mr Laynes stopped and then slowly detoured around them and said through his window: ‘You should at least look where you go before you drive.’

‘My dad was calm until the police officer pushed my mother over…’
Said his son: ‘My dad continued driving but the next minute the same SAPS vehicle flashed their lights and ordered my dad to pull over. However there was no place to pull over safely right there at that spot so my dad tried to pull over into Mchael Brink Road. At the crossing the SAPS official climbed from his police vehicle and reached into the car, grabbing my dad’s keys from the ignition. My dad climbed out and tried to grab his keys back. The official then attacked him and started struggling with him. Meanwhile my mother got very scared and climbed from the car with her crutches. The officer then pushed my mother over, she fell and hurt herself and then all hell broke lose. My father was calm until the police officer pushed my mother over.’

‘ My father was kicked into the police van … ’
His father only has the use of one arm due to an old injury, said the son. However with his healthy arm he then hit the two officers at the scene with a crutch. Suddenly more police vehicles showed up and police officers jumped out, started kicking and beating the two men and sprayed them with pepper-spray and handcuffed them. ‘My father struggled to get into the van so they kicked him into it,’ said the son.
The two men were released from police jail with R500 bail ($50). They lodged immediate complaints of assaults against the police members who were allegedly involved in the fracas, confirmed warrant-officer Marinda Swanepoel. She claimed however that the police officers had ‘pulled over the Layne’ vehicle because it was ‘overloaded’ (four adults and a teen in a Nissan Maxima) and didn’t want to pull over right away.’ Neither the Afrikaans newspaper nor the SAPS mentioned whether the Laynes couple and their son faced any official charges.

"A 26-year-old shopkeeper was busy in his shop at Freedom Park, Phokeng, on 19 March 2010 at around 14:00 when four customers entered the shop.They suddenly produced firearms, threatened the shopkeeper and his workers, and used cable ties to tie them up before robbing them of R8 000 and three cellphones. While the suspects were robbing the business, a police patrol van happened to pass by. Three of the robbers fled in different directions, and one ran to a BMW sedan which was parked close by, firing three shots in the direction of the police, who returned fire.

The suspect got into the vehicle and drove off at high speed, followed closely by the members. About 1 km further down the road, the BMW was cornered, and the suspect got out of the vehicle and tried to flee on foot. Members of the community blew the whistle on him, and the members cornered him in a house where he was hiding. Three cellphones were recovered, two were in the suspect’s possession and the other one was found in the vehicle. However, the firearm that he had used was not found.

During the initial investigation, it was established that the suspect is a former SAPS member, who was stationed at Krugersdorp Detective Service.A blue light was found inside the BMW, which was also fitted with a police siren. The suspect’s official SAPS appointment certificate was found in his possession, and the BMW was found to have been hijacked.39-year-old Patrick Magonono appeared in the Tlhabane Magistrates' Court on Tuesday, 23 March 2010 on charges of business robbery, possession of a vehicle suspected to have been stolen, attempted murder and impersonating a police official.His accomplices are still at large. PULLED OVER IN ROADBLOCK UNDER FALSE PRETENCE:
Ms Lourens said the Van Wyk couple were first pulled over in a police roadblock because their numberplate was not attacked to the front; however it had fallen off enroute and Mr Van Wyk had put it in clear view in the front window and told the officials at the first roadblock that he would have it re-attached upon their return home. In that first roadblock the police official also assured the family that it would not be a problem as long as the numberplate was clearly visible – which is was... (picture below)



“However when the Van Wyk family car was stopped at a second roadblock, a black police officer started cursing Mr Van Wyk for a ‘white bastard’ and cursed the entire Afrikaner family with foul and very crude language while writing a ticket. Mrs Van Wyk, angered by these crude insults, tore up the ticket and they drove on. A few kilometres further down the road, the Van Wyk vehicle was suddenly surrounded by a large number of police vehicles and forced off the road. Mr Van Wyk was physically dragged from the car after he told the police he did not want to abandon his family in such an unsafe place and would rather follow them to the police station. Mr Van Wyk was then assaulted, and forced at gunpoint by a police officer to lie down,” wrote Ms Lourens.

“You have killed my daddy…’ shouted the weeping child Ms Lourens continued:

‘One of the small Van Wyk children then jumped from the car, thinking that they had killed her father, and beat at one of the officers with a small plastic toy golfing stick, shouting that they ‘had shot her daddy’. Mrs Van Wyk was in hysterics and tried to get out of her seatbelt while the officers were assaulting her, trying to drag her out of the car. Mr Van Wyk then jumped to his wife’s defence, shouting for them to leave his wife alone. Family friend Lee Mark was meanwhile sitting inside the car, holding the little Van Wyk boy close to his chest to protect him. Another police officer then stuck a gun inside the car, and held it to Lee’s head, ordering Lee to ‘shut the children up’. An eye-witness at the scene who was taking photos and videos with her cellphone also was threatened that they would confiscate her phone: and they broke her keys when trying to rip them out of the ignition while Mr van Wyk was still being beaten repeatedly in the face before he and his wife were handcuffed and taken to the Brits police cells. He was there forced to undergo blood-tests which will only be available in July, the police claimed at the charge-office. Mr Lee then took back the family car to Brits with the three Van Wyk children, taking them to a family-member for safekeeping,” wrote Mrs Lourens.

She spent hours on Christmas Day, trying to get the Van Wyk couple released from the Brits police cells. Initially the SAPS even denied that the Van Wyk’s were arrested and inside. It took her three hours before she could reach officials at the cells by phone.

Police officers told 14 black detainees in the Brits holding cell: ‘we have brought you a Paulina to rape…’

Lourens wrote: “While driving the cells, one official had pushed Van Wyk’s head outside the window while other officers were constantly beating him against the ear and his head while cursing him constantly. He then was taken to Cell 11 of the Brits police station where the black officers told the 15 black detainees inside that they had brought them a ‘Paulina’ for the weekend and that Van Wyk would be raped until he had ‘learned some manners’ . Van Wyk said he then was subjected to a constant stream of threats of rape and also called “Paulina’ by the detainees who demanded that he send out for cigarettes for them or he would be gang-raped. Meanwhile Mrs Van Wyk was also accosted in the female-section cells because the black women detained there tried to rob her jewellery. She hid her earrings underneath her tongue.

SAPS at Brits denied any knowledge of the arrested Van Wyk parents:
The Freedom Front councillor said that she tried to reach the police station at Brits from 8pm to 11pm by telephone that night and finally obtained some confirmaiton from officials at the cells after the complaints-officials had repeatedly denied that the Van Wyk couple were inside the police station and had denied all knowledge of the incident. However, the official at the holding cells told Ms Lourens at 11pm that the ‘Van Wyks had already been released and were in the complaints office’.

The Van Wyk couple denied this, saying they were held until well after 11pm and that throughout their arrest and incarceration, they were not informed under what charges they were being held. The Brits police also vehemently denied they had carried out acts of brutality and had shouted racist abuse at the couple. Early the next day, the councillor went to the Brits magistrate’s court where Mrs Van Wyk had been ordered to appear purportedly to face charges of ‘interfering in an arrest’ and ‘malicious damage to property". While she waited in court, Mrs Lourens obtained the video material and photographs from an eye-witnesses there -- and went to the Brits police station commander with it.

“A person in civilian clothing at the Brits police station then tried to convince me that the Van Wyks were ‘distorting the case’ and that there had been ‘no police brutality,’ she said. “However, when I informed him of the visual evidence he fell silent,’ she said. “I informed him that it even looked from the videos as of an article was taken from the vehicle and placed inside the pocket of an official. I also told him that when Mrs Van Wyk was plucked from the car, her cellphone had fallen out of her pocket, and that an official, dressed in black civilian clothing, then put it in his own pocket. Mrs Van Wyk then demanded her cellphone back and fought with this man who then returned it”. The official then left. Within ten minutes the Van Wyk couple phoned Ms Lourens – informing her that the case against them was dropped.

The Freedom Front Plus councillor said however they are not letting this incident rest - they have in turn already initiated proceedings against the traffic officials and the police officers. “What is so worrying is that whenever there is a real emergency, the police claims that they have no vehicles available or officers to respond to the scene. However it was clear that there was no shortage of officials nor vehicles. And the racist comments coupled with the brutal behaviour of the police is not in line with the official “Batho-pele’ policies of the SAPS, which claims that they ‘put people first’. Clearly these Batho Pele principles posted above the door of this police station, hold no meaning for those officials’. She called on the community to inform them of any police violence and racist actions by officials.

On December 25 2010 Jaco van Wyk, his wife Mona, their three children and adult family friend Lee Mark left their home at Sonop to spend the day together for a family Christmas outing. They didn’t have an inkling that the Van Wyk parents would be dumped in the Brits SAPS cells at 6pm that evening, racially abused by crude-mouthed black police officers in front of their small children - and the father threatened with gang-rape in the holding cells.

Freedom Front plus councillor Elsa Lourens – who spent many hours trying to get the arrested Afrikaans couple released from the Brits police cells – has issued a detailed statement with visual evidence. After her intervention, the Brits police dropped the charges against the couple. However the party has initiated proceedings to lodge formal charges against the police- and traffic-officials involved in the incident. Ms Lourens condemned the racist abuse this defenceless family was targetted with by government officials. She released evidence in the form of pictures and video material taken of the incidents.

Subject: December 9 2010 - assault and armed house-robbery against Mr Karl Gaiduschek, 80, Klopper Park, Germiston

I am enquiring about a crime-incident targetting frail elderly people in the Germiston area, which the SAPS has not bothered to report to the local news media. Since May 2010, a group of people have started maintaining an online archive of all such violent crime incidents which are not reported by the SA police… but should be.
Could you please comment on/confirm the following crime:

• On Thursday 9 December 2010 at 12h00 - in broad daylight - Mr Karl Gaiduschek (80) was resting in his Klopper Park, Germiston, residence, when his life-partner, Ms Ursula Arkner (76) was attacked by three males with knobkieries inside their home. Old Ms Arkner was tied up and the unarmed Mr Gaiduschek was attacked with knobkieries and beaten while he was still laying in bed. He was beaten until he was unconscious and laying bloody and almost dead. The attackers spent the next 3 hours assaulting him and ransacking the house. They left the scene with Mrs Arkner's vehicle - taking with them clothing, food, liquor, cellphones. Throughout this attack, Ms Arkner had to listen to her partner being assaulted and eventually she managed to free herself and pressed the panic button - which did not function. Her daughter's friend later turned up with the police. It is believed that she called for help by telephone. Ms Arkner stated at that time that she ‘was not hurt’ and refused medical attention. However trauma-counselling was not offered to her either. Mr Gaiduschek was hospitalized and is recovering physically, but is very weak and severely traumatized. Ms Arkner died in her sleep last Monday night December 20 2010

- doctors presume that her death was due to the after-effects of the shock and the trauma she went through."
QUESTION 1: I would appreciate your advice as to the accuracy of the description above, i .e. did this incident take place as described?
QUESTION 2: Did the Germiston police obtain or even offer any trauma-counselling to these frail victims of this heinous crime against two defenceless pensioners? If not, why not?

QUESTION 3: Has anyone been arrested? If yes, please advise when they will appear on court, where and on which date. Please advise the contact number of the investigating officer and name so that we may follow up this case by obtaining counselling and support for Mr Gaiduschek during the trial.

2011-01-04 PARYS. Free State. – 38-year-old Wikus van Zyl of Parys went through a three-hour nightmare kidnapping ordeal, when six armed black males kept him imprisoned in a small house in the dusty, crime-infested Sebokeng township, about 30km away from Johannesburg. One black man kept threatening to kill him, ominously running his knife across Van Zyl’s body.

The traumatised Van Zyl said he kept thinking of his wife, their two-year-old son and their unborn baby throughout his ordeal. And then to add insult to injury, four police officers at four different police stations then refused to help him lodge a formal complaint or to even investigate the house.

They claimed “that could only be done at Sebokeng” – and Van Zyl was terrified of going back into the township. “I could show the police right now where that house is located in Sebokeng, I can identify four of the six men who held me captive,’ he said. I cannot understand why the police don’t want to help. It’s always as if they don’t feel like helping.’ Parys SAPS spokesman Maselela Langa claims it was all a ‘misunderstanding.’

“Let the man go and speak to the station commander,’ he added.
Van Zyl got drawn into his ordeal after he had arranged to find a buyer for his bakkie, a Namibian man, and had arranged to meet the Namibian man at a dealership in Vanderbijlpark. The two men went to the bank after the buyer had viewed the car. The man claimed at the bank that he didn’t have the entire cash amount for the car and that another meeting would have to be arranged. This was done just before Christmas, again in Vanderbijlpark.

“The man already knew my car and as I arrived at the parking lot of the dealership two men climbed into the bakkie with me and told me to drive to Sebokeng. The prospective buyer was waiting for him there with five other men, who all claimed they were ‘police detectives’. They accused Van Zyl of smuggling diamonds and threatened to ‘arrest him’. They took him to a small house and kept him inside, with the man with the knife threatening him while others kept on intimidating him demanding that he give them his bank card and pincode.

“A sturdily-built man came to me then and told me I had to go with him. I thought to mysef well this is it, I am going to be murdered’. The kidnappers then told Van Zyl to ‘drive away and never come back again’. The terrified Van Zyl’s ordeal with the cops started shortly thereafter when he stopped a police vehicle in Sebokeng. “Those cops told me I should be happy that I am still alive and that they can’t do a thing for me,’ he said.

SAPS data-clerk arrested for car-theft – Elize Kruger’s old Ford Laser stolen three times this year



Jan 12 2011 – Mrs Elize Kruger (60) of Elsburg has been driving her trusty 1998-model Ford Laser for the past 14 years. But her feeling of security received bitter blows when her old car was stolen a whopping three times. The first theft was on Nov 8 2010 outside the Pick’n Pay supermarket iN Lambton – and it was found back 45 minutes later by Tracker. However while it was parked at the Germiston police station awaiting new documents, it was stolen again. A data-secretary at the police station has been arrested. Mrs Kruger can’t understand the series of thefts of her old, cheap car. “It isn’t particularly valuable or special,’ she exclaimed.

And Tuesday-morning Mrs Kruger – who has to drive her granddaughters to school and her husband to work every day – was having her Ford ‘s cracked windscreen fixed outside a pharmacy in Voortrekker Street in Elsburg – when it got stolen again. Her car ‘s anti-theft mechanism device stopped it several hundred metres later and the thieves fled.

But Mrs Kruger is is becoming deeply worried; she fears that she is being targetted by someone and feels very unsafe. “I live in fear for what may happen next. I need transportation to take my granddaughters to school every day, and to drop off and fetch my husband from work’.

She said that after the theft from the Germiston police station she got it back four days later when the police located it near Zonkesizwe in Kempton Park. Marais family, Wesselsbron targets of cops, hired killers

The Boer businessman’s testimony was backed up by SAPS inspector Nico Smith who testified on the same day that he himself also was threatened with contract-killers if he pursued his investigation - and that it was established that the four black men arrested by the farm-watch while trying kill Marais, had been paid R1,000 ($100) each for it. Smith also handed in signed and sworn statements from specific, well-informed prisoners at Odendaalsrust confirming that a contract-killing was taken out against Marais.

Tom de Wet yesterday noted that the six (unidentified) black men on trial for corruption - four black police officers, one black ex-police officer and the brother of an ANC-MEC in the Free State legislature -- had shown up at the Marais farm dressed in police uniform, and attacked the family, holding them up at gunpoint. He has since then had to install thousands of Rands worth of security equipment, now has to pack a gun every day for self-protection as they are ver likely still being earmarked as targets by contract-killers. It would be impossible for the family to join the witness-protection programme because of his business interests and his farm. His attorney Tom Bothma confirmed that Marais has lodged a civilian damages-law suit of more than R2,8million against the SAPS.

9000 get Madiba's birthday remission

PRETORIA -- Correctional Services Minister Sipo Mzimela yesterday announced a special six-month remission for all sentenced prisoners to mark President Nelson Mandela's birthday.

This would result in the release of about 9000 prisoners from next week.
The NP expressed amazement at the decision.
The remission of sentence was in effect giving a birthday present to sentenced criminals, NP spokesperson on correctional services, Gert Oosthuizen, said.
"The NP would have preferred that murderers, rapists, armed robbers and child molesters be excluded from this remission."

The DP said it was "shocked and saddened" to hear of the six-month remission.
"This 'present' on the occasion of Mr Mandela's birthday ... makes a mockery of our criminal justice system and is a slap in the face to the victims of crime," DP spokesperson on prisons, James Selfe, said.

The DP had repeated often that the problem of crime in South Africa would not be solved until criminals had a reasonable expectation that they would be caught, tried and convicted, and that they would serve the sentences handed down by the courts, he said.

The UDM also criticised the announcement.
"Granting remission to mark the celebration of a birthday, even that of somebody with the stature of President Mandela, in a country where crime is one of the single greatest challenges, becomes ridiculous," it said.
Such an action reduced the morale of police and state prosecutors, and was insensitive to the victims of crime.

"Without society putting into place mechanisms to ensure the success of the departmental programmes, the prisoners may be susceptible to recidivism," the statement said. -- Sapa

In all these murder and suicide cases, the black police officers showed absolutely no respect for the dead white people, dragging the uncovered corpses through the murder scenes, bloodying the whole floor with blood stains and disturbing important forensic evidence. It was also noted that whenever black persons had died, they were very carefully put inside body bags exactly on the spots where they had died and the black police officers showed the utmost respect and care for the black dead persons.
Also clear was that the majority of whites being murdered are male. It’s also evident that this recorded fact is being kept quiet in the main-stream news media. Also disconcerting is that the majority of murders of white males do occur in townhouse complexes, raising the concern that murderers occupy a house or flat in the same complex, and then quietly retract into their residence, without raising any alarm or concern. And when white women fall victim to murderers, the reports also rarely reach the news-media.

Many burglaries wrtr also committed by black people living in the same complexes as their white victims: in upmarket high-security complexes, huge arms caches were also removed by blacks residents, and even when these transfers of large arms-caches were reported to the SAPS, these residents were not investigated and the arms caches were allowed to be transferred without investigating whether they had been legally-registered firearms or not. http://www.farmitracker.com/reports//1025

Three policemen (police captain and two warrant officers ) from the organised crime unit in Polokwane were arrested for allegedly helping out a man charged with robbery. the police captain was apparently given R16 500 and a plasma TV set in return, while one of the officers was given a car and fridge. Taxpayers’ money may once again be used to pay out damages in a case of police brutality. The case involves an Afrikaans female pawn shop assistant Erika Schutte, who was falsely accused of dealing in stolen goods then locked up in a “steaming” hot police van for several hours with two black male suspects. During her detention the police swore at her, threatened her with violence and they formed a circle around her, while some of the cops slapped her on her shoulder. Despite more than 60 000 additional police personnel that were recruited between 2002 and 2010 crime levels are soaring with house robberies that have increased 100% since 2003/2004. This is after they have massaged the stats.

Altogether 860 people died at the hands of police or in their custody last year, 294 suspects died in custody and a further 566 people were killed by police. Seven people were "tortured" to death. The total number of deaths was six percent down on the previous year. More than any time during Apartheid.
