In one year - 2008-2009 – a total of 2,134 cases were officially lodged against the police. Of that only 38 convictions followed. That is a conviction rate of 1,78% . And those 2,134 official cases are just the tip of the iceberg: the majority of SA residents are too terrified to lodge charges against the police. This showed that householders of all races were terrified of the police: so terrified that in areas mostly occupied by white, coloured and Asian/Indian residents, the householders preferred contacting their local crime-prevention units and private security companies first — before filing formal charges with the SAPS later; while in black areas, the householders didn’t even bother going to the cops: they instead ‘had their crime-problems sorted out’ by vigilante group such as taxi-associations or trusted traditional healers.

Four senior police chiefs in court for falsifying crime statistics

Last year in September the useless ANC released their bullshit crime statistics and claimed that violent crime came down for the third year in a row.

Apparently murder was down by 6.5% and sexual offences by 3.1%. Assault with intent to inflict grievous bodily harm dropped by 4.5%, while robbery with aggravating circumstances was down by 12%.

Anybody with half a brain knew that this laughable junk was nonsense. Yet, some idiots believed it and the DA actually congratulated the ANC regime on their efforts.

In the past I have explained how the police bungle cases, how forensic laboratories are overloaded and how the police “lose” dockets or deliberately falsify crime statistics. Then there is a moratorium on crime statistics implemented by the ANC to hide the true extent of crime in SA.

Taxpayers cough up another R570k 5-star Nathi bill Sunday, October 18, 2009



Johannesburg - Police Minister Nathi Mthethwa has racked up another five-star hotel bill, this time worth over R570 000 in Durban, the Sunday Independent reported.

Between December 19 and April 25, Mthethwa was intermittently booked into the luxurious Hilton Hotel along with members of his VIP Protection Unit at a cost of
R578 499.


His spokesperson Zweli Mnisi did not comment on the figure, saying only that Mthethwa was in KwaZulu-Natal around December on "official duties", partaking in roadshows aimed at reducing festive season crime. His stay there during April was due to the national elections.

"The province was identified as a potential hot spot. All these were official programmes aimed at engaging local stakeholders in the fight against crime, including consultation with local authorities as part of preparation for the elections," he said in a statement.

'Unaware' of high prices

According to the Sunday Independent's copy of the bill Mthethwa spent Christmas and New Year at the hotel. During an uninterrupted 17-day stay from December 19, he was not accompanied by any guards and the bill came to just over R86 000.

On the night before Valentine's Day, Mthethwa was booked into the same hotel, this time with four guards, at a cost of R38 516.

From April 19 to 25, he stayed at the hotel with two guards. The bill amounted to R89 000.

The Hilton bill was double what taxpayers coughed up for Mthethwa's 17-day stay in Cape Town's five-star Table Bay Hotel earlier this year. Mthethwa stayed at the hotel at a cost of R235 000 while his home was being renovated after flood damage.

Mnisi said the minister claimed at the time he was unaware of the high prices charged by the Cape Town hotel.

Opposition political parties reacted with anger to Mthethwa's latest "extravagance".

Luxury indulgences

The Congress of the People said Mthethwa either was campaigning for the ANC or simply went home and billed the government.

"This gives lie to his explanation that he did not know that the Table Bay Hotel was expensive and appeared to cement a view that he has a cavalier attitude towards taxpayers' money," Cope first deputy president Mbhazima Shilowa was quoted as saying.

The DA said the police department's long list of luxury indulgences did not only contradict President Jacob Zuma's calls for austerity and prudence, but flew in the face of common sense and commitment to put the public before personal gratification.

"If one adds up the hotel extravagance to the cars bought by Mthethwa and his deputy, Fikile Mbalula, it goes up to over R3.7 million of public money being spent on person opulence," shadow minister of police Dianne Kohler Barnard said in a statement.

She asked how Mthethwa would justify his behaviour while police officers who often put their lives at risk earned next to nothing each month.

Four Limpopo station commanders appeared in the Polokwane Magistrate's Court on Friday for allegedly manipulating crime statistics in Tzaneen, police said.
Lt-Col Ronel Otto said the four officers appeared briefly in court and that the case was postponed until February 22 for bail applications.
Brigadier Naledzani Sivhula, 48, Captain Matome Matsapola, 51, Brigadier Nelson Mulaudzi, 50, and Lt-Col Mahlodi Ramokgobedi, 49, are charged with defeating the ends of justice.
Investigations began when the crime statistics for Tzaneen were found to be inaccurate and that serious crimes had been deliberately covered up in 2008.
The investigation found murder cases had been reduced to inquests and that housebreakings had been described as trespassing.

The announcement follows revelations earlier this year about the number of guns lost by or stolen from police - 2 575 in the 2008/09 financial year alone.

The ministry said municipalities owned 17 482 firearms. Just under half of them were owned by Gauteng municipalities.

Northern Cape municipalities had the least with 64 firearms.

It was apparent that some municipalities had effective, up-to-date control measures while others were "completely below depth".

Minister Nathi Mthethwa had ordered the police's central firearms registry to investigate and to make recommendations on how the police could help municipalities tighten their firearms controls.

The ministry also said that steps would be taken to recover 42 guns not returned by members who left the police.

Durban - A policeman and a clerk were arrested in connection with the disappearance of 98 firearms at Nanda police station, KwaZulu-Natal police said on Tuesday.

“The warrant officer and the clerk were arrested for unaccounted for firearms last night [Monday] in Nanda,” said Brigadier Phindile Radebe.

Police investigated after receiving information that the two were allegedly involved in the disappearance of the firearms.

More people were expected to be arrested, said Radebe.

Radebe said the two were expected to appear in the Verulam Magistrate's Court on Wednesday.

Durban - The number of people arrested in connection with the disappearance of 98 firearms at Nanda police station has risen to six, KwaZulu-Natal police said on Wednesday.

Spokesperson Phindile Radebe said: "Two clerks, three policemen and a community member have been arrested. Four guns have since been recovered.”
A policeman and a clerk were arrested in connection with the disappearance of the firearms on Monday.
Radebe said four more people were arrested at the police station on Tuesday and were expected to appear in court on Thursday.
DA community safety and liaison spokesperson Sizwe Mchunu said the harshest punishment should be given to those found guilty of the disappearance of the guns.
"The theft of almost 100 confiscated weapons that form part of crucial evidence in criminal cases is appalling, particularly given that those suspected of the crime are law enforcement officers themselves,” said Mchunu in a statement.
He said the worst part was that many criminal cases where the weapons would be used as evidence would no longer stand in court.
“All these illegal weapons are now back on the street and will only bring further bloodshed,” said Mchunu.

Cops 'lose' 5 300 firearms

Cape Town - More than 5 300 firearms have been lost or stolen from police stations and offices around the country over the past two years.

According to a written reply by Police Minister Nathi Mthethwa to a parliamentary question, just over a tenth of these have been recovered.

The minister said he had asked the Civilian Secretariat for Police to investigate the losses.

A table included in the reply shows 2 603 firearms were lost or stolen in the past financial year (2009/10), and 2 759 the year before.

A total of 457 of the firearms that disappeared over the two-year period went missing from police head office in Pretoria.

238% increase in KZN

A breakdown of the missing firearms by province shows the number of firearms lost or stolen in KwaZulu-Natal and Mpumalanga soared over the past year.

In KwaZulu-Natal, the figure leapt from 353 in 2008/09, to 840 last year (2009/10), an increase of about 238%. In Mpumalanga, police last year managed to lose or have stolen more than three times the number of firearms than the year before (364 compared to 120).

The Eastern Cape showed an improvement. Police in the province lost or had stolen 1 095 firearms in 2008/09. Last year, a total of 613 went missing.

Mthethwa said in his reply that 290 firearms were recovered during 2008/09, and a further 275 last year (2009/10).

Action had been taken against 56 police officers, of whom 33 had been found guilty in disciplinary inquiries.

Responsibility

"As minister of police, I have repeatedly stated that we are serious about ensuring that the Saps takes greater responsibility for the loss of firearms by [its] members.

"To this end, I have asked the Civilian Secretariat for Police to look into the matter.

"The department will be putting in place a number of processes to ensure police officers are held responsible for such loss of weapons," he said.

Nelspruit - A senior police official in Mpumalanga has been arrested for drunken driving, just one day after another was arrested for shoplifting.

Kevin James, acting head of legal services in the province, appeared in the Nelspruit District Court on Friday after he allegedly tried to steal a pack of meat from a supermarket.

On Saturday the provincial chief of crime intelligence, Dan Maropeng, was arrested on a charge of drunken driving near Kabokweni, a suburb near White River.

Vehicle swerving

According to a Beeld source, members of the flying squad who were on duty as part of the protection team for the 2010 FIFA World Cup saw a vehicle swerving across the road.

They stopped the vehicle and discovered Maropeng behind the wheel.

He was arrested and released shortly thereafter. He appeared in the Nelspruit court briefly on Monday.

Provincial police spokesperson Leonard Hlathi said on Monday said he knows nothing about Maropeng's arrest.

Meanwhile, no decision has been made yet about the possible suspension of James. He gives legal advice to the police's provincial management - including the suspension of police officials who are involved in criminal activities.

He is still at work.

Troubling

Anthony Benadie, DA leader in the province, said the two incidents are extremely troubling.

"I will be speaking to the provincial chief of police, Thulani Thobela, in person about the matter.

"Given the fact that the two officers are part of the police's senior management, harsh action should be taken without hesitation.

"Law enforcement officers can't break the law. They should be suspended immediately until their guilt or innocence is proven."

Johannesburg - Four policemen have been arrested for allegedly shooting dead a motorist in Pretoria central on Monday, the Independent Complaints Directorate said.
Nkosinathi Ntuli, 23, of Doornpoort was allegedly driving his Toyota RunX on the wrong side of the road on the corner of Boom and Cowie streets, when he was shot dead, spokesperson Moses Dlamini said.
Dlamini said the officers - a captain, two sergeants and a warrant officer - were arrested because nothing on the scene indicated that their lives had been in danger and that the shooting was warranted.
When the incident happened the officers were driving an unmarked vehicle and the driver was not in police uniform.
The other three officers were in uniform.
They were expected to appear in the Pretoria Magistrate's Court on Tuesday.

Johannesburg - Five policemen and a former policeman appeared in court in connection with the theft of chocolates and alcohol from trucks that had crashed in the Northern Cape, the province's police said on Tuesday.
On July 12, a truck overturned on the N12 near Belmont and alcohol worth about R620 000 was stolen from the wreckage, said Captain Cherelle Ehlers.
On July 17, a truck overturned on the N8 in the province and chocolates valued at about R290 000 were stolen from that wreckage.
Officials from the Directorate of Priority Crimes, also known as the Hawks, and detectives in Kagisho in the province investigated and arrested the five on Tuesday.
Constable Andre Palm from the Kimberley 10111 centre, Constable Errol van Ade from the dog unit and Constable Donovan Bitterbosch, also from the dog unit, appeared in the Kimberley Magistrate's Court in connection with the chocolate charges.
Palm, Van Ade, Constable Tiny Segani who works in a court in Galeshewe, Warrant Officer Dannyboy Nkalitshane from the Kimberley Flying Squad and Marcus Alemona, a former policeman from Hopetown, then appeared in connection with the alcohol theft.
Those arrested on the chocolates case were released on warning.
Palm, Segani, Nkalitshane and Van Ade were released on R500 bail and Alemona was released on warning on the alcohol charges.
They will return to the town's regional court on August 5.
In a police statement, Major General Liziwe Ntshinga, deputy provincial commissioner for the Hawks, commended the investigating officers.

TVs stolen after accident - cops arrested

Bloemfontein - Seven police officers and four civilians have been arrested for stealing 20 plasma television sets at an accident scene, Free State police said on Wednesday.
The truck driver lost control of the truck and it overturned between Smithfield and Rouxville in December, said Sergeant Fikiswa Matoti.
"He sustained some injuries and he was taken to hospital, leaving behind the truck with the load."
Matoti said the owner of the truck found stock missing when he arrived at the scene to have the truck towed and he reported this to the police.
The scene was attended by police and emergency services workers.
The arrests were made on Tuesday, and 20 plasma television sets were recovered.
Matoti said the 11 would appear in the Rouxville Magistrate's Court on Thursday.

Airport cops arrested for extortion

Johannesburg - Four police officers stationed at OR Tambo International were arrested at the airport on Thursday on charges of extortion, police said.
The arrests follow the arrival of a Ghanaian national on January 1 who, after passing through customs, was stopped by police at the arrivals lobby, said Colonel Vishnu Naidoo.
"The police demanded that he produce an invitation to justify his visit to South Africa."
The man then produced his passport and his visa and said he did not need a letter of invitation.
"The officers allegedly demanded $100 from the man and threatened him with deportation. Fearing he would be deported, the man instead said he had $50," said Naidoo.
He said the officers then ordered the man to convert the dollars into rand currency and pay it to them.
The matter was then brought to the attention of OR Tambo's police management and an inquiry was initiated and evidence gathered.
"The Ghanaian man was eventually traced to a place in Gauteng and an affidavit was obtained from him earlier this week.
"On the premise of the affidavit and evidence obtained, a sergeant and three constables stationed OR Tambo International Airport were arrested this morning [Thursday].
The officers were expected to appear in the Kempton Park Magistrate's Court on Monday.
"The investigation team at OR Tambo international has been praised for working tirelessly on this matter despite the fact that no criminal case was initially opened," said Naidoo.

Johannesburg - Five police officers and four others accused of robbing a taxi association appeared in the Protea Magistrate's Court on Monday, Gauteng police said.

Captain Mphande Khoza said the matter was postponed to January 23 for a bail application.

"The State requested more time for the investigation to consult with a few of the witnesses," he said.

Sergeant Brenda Letsiela, 35, her husband France Ndlayane, 49, Constable Trevor Mbalati, 27, Constable Rabelani Tshitakole, 29, reservist Constables Zakhele Sikhosana, 27, and Bongani Mdakane, 31, as well as Musina Silasi, 57, France Modondo, 54, and Richard Funani, 40, appeared in court.

They were arrested on January 5 and 6 following a robbery at the Witwatersrand African Taxi Association's office on December 9 last year.

The group allegedly held security guards at gunpoint, broke into a safe, and stole R160 000 from the association's office at a disused Engen garage along Roodepoort Road in Soweto.

At the time, Letsiela was already on suspension in connection with another robbery.

She and the two reservists, who had since been expelled from the service, allegedly robbed a Pakistani-owned shop in Langlaagte, Johannesburg of R90 000.

Metro cop asks for bribe at road block

Johannesburg - A metro police officer was arrested after he allegedly solicited a bribe from a minibus taxi driver in Ophirton on Friday, Johannesburg metro police said.

Chief Superintendent Wayne Minnaar said the 35-year-old officer was working at a road block when he found a taxi with a faulty handbrake.
He asked the driver for R300, but the man only had R120.

The driver reported the matter to the metro police's internal affairs and returned to the road block to identify the officer.
He was arrested and expected to appear in the Johannesburg Magistrate's Court on Tuesday.

He said the arrested pair, both 31-years-old, allegedly demanded R15 000 from a transport company to turn a blind eye to illegal goods it was moving.
It was unclear whether the bribe was paid.
Worcester is a major through point for trucks travelling from Cape Town to Johannesburg along the N1 highway.

"The investigation has been underway since November last year and is continuing," said Filander. This meant further charges could be added.
Filander said the two were surprised when they were arrested in front of their colleagues at the change of shift parade at 05:45.
They were being held in the police cells in Bellville, near Cape Town, and would appear in the Worcester Magistrate's Court on Friday on charges of corruption.

Probe into dubious ICD lease underway

Cape Town - Public Protector Thuli Madonsela's office has started its probe into the ICD's lease deal with controversial businessman Roux Shabangu.

"It [the investigation] has started today [Thursday]," Madonsela's spokesperson Kgalalelo Masibi said on Thursday.

Democratic Alliance MP Dianne Kohler Barnard asked Madonsela on November 2 to investigate after the Independent Complaints Directorate briefed Parliament's police portfolio committee.

It was revealed then that the cost of renting the building was not only outside the ICD's budget, but the premises was too large for the ICD's requirements.

In a statement on Thursday, Kohler Barnard said: "As with the SA Police Service lease deal scandal in which Mr Shabangu was implicated, the rent for the ICD's premises is reportedly grossly inflated.

"The department of public works recommended that the ICD sign a R880 000 a month lease for a property owned by Shabangu's company to house its Pretoria headquarters."

This was double the cost of the monthly rental for the building initially proposed by the ICD, which would have cost just under R420 000 a month, Kohler Barnard said.

Cop arrested after shooting during raid

Johannesburg - A police constable was arrested for murder in Mthatha, in the Eastern Cape, on Friday, the Independent Complaints Directorate (ICD) said.
Spokesman Moses Dlamini said the 29-year-old constable was arrested for allegedly murdering Siyabulela Mzimela at his house on November 17.

He said National Intervention Unit members were tracing a suspect when they went into Mzimela's house.

His girlfriend noticed people trying to force their way into the house through the kitchen door.

She rushed to the bedroom to alert Mzimela, who was sleeping in the bedroom. He came out holding a pickaxe handle and was shot.

He was taken to Livingstone Hospital where he died.

The police who entered the house allegedly failed to identify themselves.

"The ICD took over the matter for investigation and attended the post mortem on November 22," said Dlamini.

The ICD, based on the evidence gathered thus far, decided to arrest a 29-year-old police constable on a charge of murder.

The constable was expected to appear in the Motherwell Magistrate's Court on Monday.

Johannesburg - Two police sergeants will appear in the Alexandra Magistrate's Court on Tuesday for allegedly raping a woman, the Independent Complaints Directorate said.

"The officers were expected to appear in the Alexandra Magistrate's Court today [Monday], but they could not as the matter was not put on the court roll," spokesperson Moses Dlamini said.

Earlier in the day, provincial police spokesperson Lieutenant Colonel Tshisikhawe Ndou said the two were to appear in the Randburg Magistrate's Court later.

The policemen, aged 28 and 43, were arrested last week and made their first court appearance on Thursday. The matter was then postponed for a formal bail application to be heard.

Ndou said the victim was allegedly stopped by the officers in Fourways, north of Johannesburg, while they were on duty on Friday December 2.

"She was pulled out of the front seat to the back seat where the officers allegedly took turns to rape her."

The woman laid a charge against the police that Saturday and the two were arrested.

Former KZN cop jailed for life

Johannesburg - A former police officer has been jailed for life by the Mtunzini High Court for killing two colleagues and a boy, KwaZulu-Natal police said on Wednesday.

The court sentenced Judea Ntuli, 28, on Tuesday, Lieutenant Colonel Vincent Mdunge said.

Ntuli was a member of the public order police unit in Ulundi. He went on a shooting spree in May 2009, killing three people.

"They were attending a crime awareness campaign at a park in Ulundi when he shot them," Mdunge said.

Detective Constable Zephania Ntshayintshayi and Lieutenant Colonel Bongi Masemola were killed.

Ntuli then ran to the Gqokamandla High School after killing the officers, where he robbed a security guard of his firearm.

"He then got into the classroom, dragged 13-year-old pupil Senzo Vilakazi out and shot him dead."

The motive for the crime was not known. Ntuli turned the gun on himself later in the day in his apartment in an attempt to commit suicide.

Durban - The Independent Complaints Directorate (ICD) will investigate the alleged involvement of KwaZulu-Natal's Cato Manor organised crime unit in the deaths of suspected criminals, it said on Thursday.

The investigation comes in the wake of a report carried by the Sunday Times last weekend, in which the paper alleged the existence of a death squad within the Durban-based unit.

"A task team has been established... The ICD takes the allegations seriously and investigators will review all the cases involving the members," said the directorate in a statement.

The team will be led by Innocent Khuba, who is the provincial head of the ICD in Limpopo. The ICD said there were witnesses to the atrocities as reported by the paper. It called on those witnesses to contact Khuba.

The paper alleged that the unit killed scores of people under the command of the province's Hawks boss, Major-General Johan Booysen, in 2008.

It said the murders were in retaliation for the suspected police killings and other on-going taxi wars in the province.

Pretoria - Two police officers who tried to arrest a Pretoria News photographer when he took pictures of them arresting a suspected thief have been dismissed, police said on Monday.

Lieutenant Colonell Lungelo Dlamini confirmed that the two Pretoria Central police officers - Constable Tshepo Marerathi and student Constable Thapelo Moganedi - were dismissed following an internal disciplinary hearing.

The dismissals relate to an incident in February when Pretoria News chief photographer Masi Losi rushed out of the building to take pictures of a mob which had caught a suspected thief.

Police arrived and arrested the suspect but then, according to a Pretoria News staffer who spoke to Sapa at the time, the two officers turned on Losi and tried to take his camera.

The Pretoria News reported on Monday that a disciplinary inquiry had found the two guilty of assault and robbery.

The newspaper quoted provincial trial unit disciplinary officer Captain Israel Mulovhedzi as saying the policemen had indicated that they would appeal their dismissal.

They have 10 days to appeal the decision, which was made known to them on Friday. They still face criminal charges and will appear in court on February 15.
The Independent Complaints Directorate was tasked with investigating the case against them.

An ICD spokesperson could not immediately be reached for comment.

Durban - Three KwaZulu-Natal police officers have been arrested for allegedly torturing and killing a man in custody, police watchdog the Independent Complaints Directorate (ICD) said on Monday.

They allegedly used a plastic bag to suffocate several men at the Harburg police station's holding cells last month, while searching for cigarettes the prisoners had apparently managed to smuggle in after an earlier court appearance, spokesperson Moses Dlamini said.

"The police officers wanted to find out who had smuggled the tobacco, so they started assaulting the detainees in an office," he said.

One of the men died.

ICD investigators found the bag used.

Warrant Officer SC Ngcobo and Constables MF Xaba and SG Ntuli were arrested on Friday and appeared in the local magistrate's court on charges of murder, assault with intent to inflict grievous bodily harm and defeating the ends of justice.

They were granted R5 000 bail each and required to hand in their service firearms. The case was postponed to August 8.

Johannesburg - Four policemen charged with the murder of a man in police detention appeared in the Athlone Magistrate's Court in Cape Town on Monday, the Independent Complaints Directorate said.

Constables Sibusiso Zwane, Simo Mazikwane, Liveni Mbuwako, and Siboniso Mbhele were based at the Samora Machel informal settlement, spokesperson Moses Dlamini said.
They allegedly beat Zamuxolo Zozo, 31, to death on January 8. He was taken into custody after his wife called the police over a domestic violence dispute.
The four policemen will appear in the same court for a bail application on February 3.

Police mum on 'destroyed evidence'

Johannesburg - Police have declined to comment on claims that evidence on crime and drug syndicates was destroyed after its former crime intelligence chief was arrested last year.

"We do not give out information on crime intelligence," McIntosh Polela, spokesperson for specialist police unit the Hawks, said on Wednesday.

"Operations on crime intelligence are not shared with the public," he said.

The New Age reported that it was believed the "purge" of the crime intelligence division in November was partly the result of an internal political struggle.

This reportedly led to the destruction of evidence of links between politicians and crime bosses.

The publication reported this happened after Lieutenant General Richard Mdluli was arrested for murder last year.

Mdluli was arrested in connection with the murder of Oupa Ramogibe in an alleged love triangle.

Johannesburg - Three Mozambican men have been arrested for possession of police paraphernalia and other suspected stolen goods near Phokeng, North West police said on Thursday.

Police, acting on a tip-off, searched a house in Lesung village on Tuesday night, Constable Kabelo Phetabosigo said.

"They found the men and a police raincoat and helmet, a bulletproof vest bag, computer parts and monitors bearing SAPS numbers as well as a police pocket book.

"There was also a Venter trailer, motor vehicle engines, motorbike parts and several counterfeit DVD discs in the house," he said.

The men were expected to face charges of possessing suspected stolen property in the Bafokeng Magistrate's Court on Friday.

Cele used pay-outs to get cronies jobs - union

Johannesburg - Suspended national police commissioner Bheki Cele had misused his authority by getting rid of police officers in positions earmarked for his friends, the SA Police Union (Sapu) said on Thursday.

"Sapu has always maintained the position that one should not mix politics and the police," general secretary Oscar Skommere said in a statement.

"The abuse of state money was always of great concern for Sapu especially when the national commissioner [Cele] was misusing his authority... to get rid of members in positions which he wants to earmark for other cronies,"
On Wednesday, Police Minister Nathi Mthethwa said he was investigating a slew of golden handshakes worth R31m given to policemen on Cele's watch.

He told MPs in Parliament that, in an attempt to stop long-running abuse of the police's special pensions system, he had decreed that the national commissioner may no longer award pay-outs without his approval.

Mthethwa's remarks follow controversy last month over a R1.1m pay-out given to former Gauteng crime intelligence chief Joey Mabasa, on top of his pension.
He was one of 19 policemen retrenched under section 35 of the act in the past two financial years. They received pay-outs totalling R31.2m.

Sapu said it regretted that the retrenchments would mean not only a R30m loss to the police budget, but would also have a long term influence on it.

This was because individuals would be remunerated in terms of the section 35 agreement at a much higher rate than normal until retirement.

Mthethwa said he was in the process of scrutinising every successful section 35 application in recent years, not to recover the money but to make sure people had not been released to cover up wrongdoing.

Amendments to the act would be fast-tracked and should reach Cabinet within months.
Cele was suspended by President Jacob Zuma last month over his role in the police headquarters scandal.

Mthethwa told MPs he had the fullest confidence in acting commissioner Lieutenant General Nhlanhla Mkhwanazi.

Police minister's bodyguard in court for theft

Cape Town - It was not yet clear whether a policeman accused of stealing from Police Minister Nathi Mthethwa will be prosecuted, the Wynberg Magistrate's Court in Cape Town heard on Friday.

Prosecutor Keppler Uys told the court the docket had been forwarded to the Directorate of Public Prosecutions (DPP).

The matter was postponed to January 18 while the DPP decided on whether or not to prosecute former ministerial bodyguard, Ianval Suilung Isaacs, 33, of Wellington.

Isaacs was in the dock with co-accused Amdat Hossain, 42, and Mohammad Shapul Islam, 34.

The three were arrested in September, and made their first court appearance the next day, when they were released on bail.

Isaacs is out on R1 000 bail, and his two co-accused on R400 each.

At Friday's proceedings, the prosecutor said the investigation had been completed, and it was now up to the DPP to decide whether to prosecute or withdraw the charges.

Isaacs allegedly stole the minister's laptop and cellphone after breaking into his Cape Town residence, and then sold the two items to his co-accused.

Zizi Kodwa to sue police for R5m

Johannesburg - Presidential adviser Zizi Kodwa is suing Police Minister Nathi Mthethwa and acting national police commissioner Lieutenant General Nhlanhla Mkhwanazi for R5m after he was wrongfully arrested, it was reported on Wednesday.

Kodwa was stopped and arrested by police in Rosebank, Johannesburg, on November 11 on suspicion of drunk driving.

Police spokesperson Brigadier Neville Malila told The Star newspaper police received blood results from a test taken on the night, and it confirmed that there was no alcohol in Kodwa's system.

Kodwa's lawyer Gugulethu Madlanga said Kodwa was pursuing the suit, and a summons would be issued in 30 days.

On Tuesday Kodwa took to social media site Twitter to express his views.

"Blood sample results are back, alcohol in my blood: ZERO, I told them banyile ngekhe ndibayeke [They are in shit, I won't let it go]," he tweeted.

Last week Kodwa said:"I want to clear my name. They [the blood tests] will come out negative. I have no doubt about that. It's not about my role in the presidency. It's about my reputation.

"I want to protect South Africans from abuse of authority by police officers."

Kodwa said he believed his arrest was about a "bribe not paid".

He was scheduled to face the drunken driving charge at the Hillbrow Magistrate's Court on May 11.

Sheriff attaches Mthethwa's furniture

Johannesburg - Furniture worth almost R245 000 has been attached at Police Minister Nathi Mthethwa's Cape Town office to cover the costs of civil claims, the DA claimed on Thursday.

"Even when the ministry of police loses in court, it chooses to ignore the ruling, forcing citizens to ask the sheriff of the court to attach goods in lieu of payment," Democratic Alliance MP Dianne Kohler-Barnard said in a statement.

"I will be submitting a series of questions to minister Mthethwa to determine why the SA Police Service (SAPS) is repeatedly failing to uphold the law and meet its debts."

Kohler-Barnard said the ministry had failed to pay the costs for five cases it had lost on appeal.

Mthethwa's spokesperson Zweli Mnisi said the ministry was not aware of the attachments or the cases.
"The ministry of police respects every judgment of the court, and when we are ordered to pay any victim who might have suffered as a result of alleged police brutality, or any other case, we do comply.
"Politicians must refrain from politicising... crime. Clearly, to us, this is example of politicking."

According to the 2010/11 SAPS annual report, R11bn had been earmarked for civil claims against the department, Kohler-Barnard said.
The claims include assault, shootings, damage to property, police actions, vehicle accidents and legal costs.

She said three years ago, law firm Edward Nathan Sonnenberg compiled a 400-page report, at a cost of R8m, into the police's legal services.
"The DA has repeatedly urged the ministry to act on the report's findings. Why two successive ministers of police have failed to act on its recommendations has never been explained."

When the report was commissioned, the backlog of civil legal claims stood at 19 000.
"The minister of police must explain why this state of affairs has been allowed to continue, and what steps he plans to take to curb the SAPS' repeated failure to meet its debts," Kohler-Barnard said.

Cape Town - A bodyguard accused of stealing from Police Minister Nathi Mthethwa appeared in the Wynberg Magistrate's Court on Monday with his two co-accused.
Prosecutor Keppler Uys said the Western Cape directorate for public prosecutions had directed that Ianval Suiling Isaacs, 33, and his two accomplices would go on trial on February 23.

Isaacs, a police official, had been deployed to Mthethwa's residence before the house robbery. He faces charges of housebreaking with intent to steal, theft, malicious damage and fraud.

ICD Arrest 3 SAPS Members for Plastic Bag Suffocation and Murder of Suspects

The IFP has applauded the Independent Complaints Directorate for their swift action in arresting the three KwaZulu-Natal Police Officers accused of murder. The arrest followed the alleged use of the plastic bag to suffocate several men at the Harburg Police Station’s holding cells last month while they were being searched for cigarettes.

In a statement issued today, IFP Deputy National Spokesperson, Joshua Mazibuko said; “The ICD must be applauded for their swift and courageous action against the three police officers. It is very unfortunate that police officers who are supposed to serve and protect the public have at times gone to the extreme in the execution of their duties. It is not understandable that just for cigarettes, the police could use such measures as though the said prisoners were acting violently. Such behavior tends at times to lead to some sections of society losing confidence in the police.
“We hope that justice will be swiftly and appropriately applied so that other police officers will steer clear of such conduct.”

Two SAPS members arrested for murder

A hawker was robbed and killed by three people - including two cops.

Two police officers have been arrested for killing a hawker at the Bruma Lake flea market in Johannesburg.

Spokesperson Julia Claassen says the 40-year-old Egyptian hawker was robbed and killed by three suspects at around 3pm on Thursday.

Members of the public witnessed what happened, gave chase and managed to apprehend one of the suspects who was then handed over to the police.

Upon questioning, it was discovered that the suspect was a 25-year-old police constable from the Nigel police station.

He revealed to the police the names of his accomplices. One of them, an inspector at the Germiston flying squad later handed himself over to the police.

The two are expected to appear soon on charges of murder and robbery.

The third man is still at large

Warrant Officer Bogang Thomas Lekgau (40) and Sergeant Japhet Amos Shingange (48) of South African Police Services Mankweng (Limpopo) have each been convicted and sentenced to 12 years' imprisonment for murder and eighteen months for assault GBH at the Polokwane High Court. Their sentences will run concurrently.

Mabasa kicked out of SAPS over Lolly link

Eyewitness News has learnt that former crime intelligence officer Major General Joey Mabasa has been discharged from the South African Police Service (SAPS). Mabasa was sidelined after his name emerged in connection with the murder of Teazer's boss Lolly Jackson in May last year. Jackson's alleged killer, Cypriot George Louka, apparently phoned Mabasa and confessed on the night of the murder. The police's McIntosh Polela said management offered Mabasa a discharge as his services were no longer needed.

“He has been offered a discharge from the SAPS which he has accepted and we can confirm that he is no longer with the service” Polela added. However, Mabasa said he only accepted the discharge because police management were attempting to sideline him further by re-assigning him to Limpopo. His spokesperson Mike Naraine said Mabasa wrote to the police commissioner giving him an ultimatum.“He must be sent back to his position as head of crime intelligence in Gauteng [and] if they fail to do that, then he would consider a separation package,” Naraine added.

Meanwhile, it is also understood the Hawks are on the verge of arresting Mabasa for his supposed involvement in the Jackson murder but the former intelligence head has vigorously denied any guilt. (Edited by Tshepiso Moche)

MANKWENG SAPS OFFICERS CONVICTED AND SENTENCED FOR MURDER AND ASSAULT WITH INTENT TO CAUSE GRIEVOUS BODILY HARM (GBH)

Warrant Officer Bogang Thomas Lekgau (40) and Sergeant Japhet Amos Shingange (48) of SAPS Mankweng (Limpopo) have each been convicted and sentenced to12 years’ imprisonment for Murder and eighteen months for Assault GBH at the Polokwane High Court. Their sentences will run concurrently. Two of their colleagues, Constable Joseph Maredi Mothapo (27) and Constable Frank Chikele Segoa (27) were convicted on a charge of Assault GBH and sentenced to 18 months imprisonment suspended for five years.

The officers’ convictions follow an investigation by the Independent Complaints Directorate (ICD) into the death on 25 February 2008 of Samuel Ragophala who was 39 at the time. The deceased and three others were suspects in a housebreaking and theft case that happened at a liquor restaurant on 21 February 2008. It is alleged that the restaurant owner got information about the robbers and mobilized community members to arrest four suspects (including the deceased). The police alleged that one of the suspects, Samuel Ragophala collapsed following an assault by community members. The other three suspects were taken in for questioning at Mankweng Detective offices, after which they made allegations of assault against the police.

The ICD investigated the incident and referred docket to the Director of Public Prosecution who decided to charge eight police officers for Murder and three counts of Assault GBH. The court processes ended today with the sentencing of four police officers. The other four officers who were suspects on the case were acquitted on all charges.
