The Independent Complaints Directorate (ICD) wishes to inform
that we have

The incident occurred on 17 October 2003 in Leeuwfontein in
Limpopo, where
it is alleged that Captain Potlake Alfred Mamogobo (41), who was a station
commander of the South African Police Service (SAPS) Zaaiplaas, gave Linky
Ntuli (25) a lift from Dindela to Hlogotlou. It is alleged that when they reach
Hlogotlou Captain Mamogobo proceeded without stopping to Leewfontein where he
parked the car next to a house at a certain farm. The victim was allegedly
ordered out of the vehicle so that she can kiss him, but she refused.

Captain Mamogobo allegedly drove towards Makgatle village and
went to the

threatened to shoot the victim before raping her. It is further alleged that
after the said rape Captain Mamogobo left the victim in the bush.

The victim went to SAPS Motetema to report the matter and a rape
case was
opened accordingly. The members of SAPS Motetema visited the crime scene and
found a condom which was allegedly used by the suspect police officer. The
police circulated the registration number of a vehicle given to them by the
victim and Captain Mamogobo was arrested on 28 October 2003 accordingly. He
appeared at the Lebowa Kgomo MagistrateĆ¢™s court and was granted R500 bail and
the matter was postponed indefinitely for further investigation.

home. The ICD
took charge of the investigation of both rape and murder cases. The intention
was to explore a possibility of the involvement of the suspect police officer
into the killing of the said victim.

The Director of Public Prosecutions (DPP) instructed that the
rape case must
proceed and the suspect failed to appear in court on 29 April 2005. As a result
a warrant of arrest was issued against him on 27 May 2005, and the police were
reluctant to affect same.

The ICD managed to arrest Captain Mamogobo on 31 May 2006 at
SAPS

The suspect police officer will be kept in custody until his
appearance in
court on 1 June 2006. The ICD intends to oppose bail because the suspect police
officer interfered with witnesses.
